Dear all,
Please can you give me some advice.
I am claiming back charges which total £1700 including interest. I have sent the first letter requesting they pay back the full amount.
They have replied saying they are willing to pay me £489 as a "goodwill gesture"
I have rejected this today.
Should I start MCOL court process now or should I send them a 2nd letter requesting the full amount again????

i have requested £555 from capital one. they have made an offer by letter of £152 but not as a refund only as a reduction of fees from £20 to £12 from start of my account aug 04 to the time when the charges were reduced.
do i accept this or send next letter threatening court action?
has anyone else tried this?

You could send a letter stating you'd accept this as partial payment and would like them to give you the rest or go to court as previously mentioned. They offer me £188 instead of £612. Send the 2nd letter stating that they repay ALL the monies owed, you could state that you'll accept a settlement figure set by you ie £1500 to avoid the courts getting involved. See what they say, I reckon after that 14 days you'll have to take them to court like I have done. I think I will ring them as well as writing to request a list of charges applied.
Capital One are b*stards, when I went over my limit, I couldn't afford to get back in credit and their £20+ a month charges took me hundreds over. It took them ages for them to accept an amount per month that I could afford. This worked well for a few months, (there were no charges other than interest, then suddenly last year they sent a letter saying that this facitlity was being removed and unless I pay the minimum monthly payment, plus the amount to get me back in credit then the charges would start again. Sure enough they have and when I get my full statements I will take great pleasure in (hopefully) reclaiming these charges back.0 -

Hi everyone, this is my first post in this forum and just wanted to see if anyone in the same boat as me really. I'm trying to get my charges back and Crapital One keep sending letters to my old address even though they managed to send 6 years worth of statements to my new address!
I had a letter sent to my old address last week saying that they would send a check for £120 even though I am claiming £320! The letter said I will get the check in 14 days! Instead what I have recieved in a letter saying sorry your not happy with amount that they have offered and sorry that I have started court preceedings!
What the ....! How do they know I am not happy! I haven't had a chance reply yet as my mum still has the letter with her at my old address!!!
I was actually waiting for that check so I could start MCOL cause funds are low at the mo.
I wasn't going to claim interest, but you can bet your nelly I am now!!0 -
I have received my cheque today for £190 inc court fee just a day to spare until there 14 days was up.
Was well worth it...I am so happy and this site is worth millions.

i would reply saying you will accept the £489 as part payment of the full amount owing and that if you dont receive the rest of the amount within 7 days you will proceed to the court to claim full amount PLUS interest0 -

wonder if anyone can advise me, received the usual letter from cap one yeaterday offering the difference between £20 and £12, for one of my cards, expecting the other offer monday! The thing is they took over 3 weeks to reply and i already sent the LBA which they should have received on friday. My question is do i now have to wait the 14 days before filing in my local court? Or should i go ahead and file as they have responded with this offer and im sure i will get the "this is our FINAL OFFER..."letter when i accept it as partial payment?0
