Had a same letter from Capital one offering difference between old and new charges so getting £80 back which should show in April statement - sent back saying no want all costs - got letter back saying will not up there offer any more and will stand at £80. Finanical regulation require me to advise you that this is my final responce to this matter and if necessary I can take it up with the FOS within the next 6 months
Sholud I take court action now as tempted to take there offer0 -

Yes you can. If you have a debt with Capital One through this agency the likelyhood is that they will take any refund against this though. If not then you should be paid direct ( I think, get a second opinion on that ) and can use the money to reduce other debts. Either way you can still reclaim them and good luck0 -

The choice is yours but if you want the lot then the next stage is court. Good luck0 -
Oh god, not capital one !!! I wrote to these lot 40 days ago, not a sausage, and if you ri ng up you get someone from the other side of the world. They offered to refund 12 months charges, but i want my 6 years and no messing. Still no written rplys to my now 2 letters so I will follow martins advice given on this website and will let you know. Also Clydesdale Bank awaiting 40 days before ackowledging my letter but taken my £10 dead quick, cheek!!. Also Cumberland Building Society not getting a satisfactory outcome on my MEAF applied to mortgage account so persuing that as well. DONT GIVE IN, ITS OUR MONEY!!!!!!!!!!!!!!!!0

Has anyone that has been promised a cheque for full amount of charges within 14 days from capital one actually received it? And was it within 14 days?
We received letter 3rd April (I realise we have had easter in between) but not had it yet.0 -
Just received my statement from Barclaycard and a credit of £64 has been applied to my account on 2nd April. They havent contacted me with regards to this and I have already posted the second letter a couple of days ago threatening court action.
Shall I write to them again now saying I accept as part payment. I only have a balance of £71.37 left and they now only owe me £96 so I would be happy if they just cleared that to be honest. Do you think they would deal with it by phone if I ring them?0 -

But this is an Agency I have approached to help me rather than a collection agency.
So long as I can claim I'm not bothered if they reduce my debt with them as this is what I would do anyway0 -

I did mean to post here but to say I have received a court letter to say that capital one have written to them to say the claim is now settled as they have paid in full. However I still havent received the cheque so why should we cancel the claim until its paid?0 -

Don't cancel the claim until the cheque has been received AND has cleared0 -
I've filed a claim with MCOL yesterday. As the account is closed I asked for a cheque in my last letter. Will they do this as they can't credit a closed account?
