Hi,
I wrote to Capital One asking for £815 in penalty charges to be refunded on 16 March 2007. They responded quite quickly on 29 March 2007 with an offer of £315. This was their calculation of the difference between the OFT amount of £12 and the charges they have made. Give that I have had very few charges recently, there were only a few charges therefore that they totally refused to pay back (recently their charge has dropped to the OFT amount of £12 and so on this basis they were not offering to refund any of the recent charges). On 1 April 2007 (day of receipt of their letter) I wrote back and rejected their offer and upped my letter to a letter before action.
My understanding, having read this forum and also the consumer action group website is that the OFT amount of £12 is not a hard and fast amount as it is still an amount in excess of the actual costs of administering the account issue they are dealing with. The whole basis of our claim is that the costs charged are disproportionate to the company's costs. If anyone is desperate for the cash, I don't blame anyone for settling at an early offer. However, I think it is interesting how fast the banks have made the first offer - and on the sucesses thread there are a large number of people who are reporting success at recaliming all their charges, not just the excess over £12.
I will report back on my progress on this one, as i hope it may help others with their claims.0 -

Thanks but I really don't see why I should cancel a claim before I have received the full amount - isn't it better to wait for that? Nowhere in the letter does it say that I have to cancel the claim before they are willing to pay up - do they make this a condition? Couldn't they just use this as a cop up then not to pay up after the claim was cancelled? I am not really comfortable with this.
If they delay on the refund and the court date arrives, you will have to go to court. They will contest given the fact that they have already made you the full refund offer...The letter you received from them is legally standing therefore there's no reason to wait..553780080 -

You've probably already done this but call the number on the particulars of claim letter you were sent and state your claim code and that the defendant has made a full offer.553780080 -

The irony is that I used to work in Trent House for another company before Capital One bought half of Nottingham.
I claimed £525 including interest, got the usual fobbing off letters and an offer of £176. I rejected it and have filed through MCOL today.
Although I have to say that Capital One have been extremely efficient in all this. I'd almost say that it's a shame to take my money back off them..0 -

Not sure what the exact thresholds are but the cost for claiming £525 was £80. I was charged £120 for claiming £3000 from another bank.
The payment bit comes right at the end of the claim and there is a facility for you to fill all the claim out then save and come back to it. So you wont lose anything in terms of content if you fill it out and dont pay till you're ready to.0 -
I know you have all heard this story for yourself, but I just want to make sure im looking at the right advice for me.
I got a Capital One card back in Jun 05 (i think) whilst I was a student, they gave me a limit of 200. I was keeping on top with payments through out the summer then went back to uni to my final year. I had to leave the flat i was in as it was costing too much as i had to do less hours at work to keep on top of my final year studies and dissy. I forgot about the payments, i had missed payment charges, late payment charges and charges for being over my limit, it all added up and couldnt affort to even give them a fiver, I had other things on my mind and was getting treatment for depression and in the October of that same year was involved in a car crash, which i had to then fork out money to get my car repaid so i could go back to work ASAP. I had previously asked cap one to stop interest and charges because of what was happening, they told me to ring this and that number, being in the state i was in, didnt really want to console on the matter and tried to put it to the back of my mind reckoning it would just dissappear!
After graduating in July last year, my bank extended my OD as i was now a graduate. I paid 200 into the account (which was standing at 400ish). But I have since moved house twice and in the cufuffle have forgotten to change my address with cap one, now living with my parents again, i dont want the burdon of my debts with cap one affecting their credit rating, so im not sure what to do there (if anyone could help that would be grand) but now im in a settled job, and im wanting to start getting back on top of things.
Im really worried about persuing this, all the payments have added up, its just rediculus i just want this off my mind. They are now consintly harrasing me calling me up to three times per day, and i dont want to talk to them without some advice, i dont need to get into the state of depression again, im just getting back on my feet.
Can anyone help?0
