    just received statements from capital 1 dating back to november 2001, should I write and request they go back to may 2001 as I did ask for the last 6 years?:confused::confused::confused:

    Yes you should do this. They have an obligation to provide you with the information you requested.
  • hi all just recieved my statements from cap 1 bit unsure about this but in september 2006 they brought there charges down to £12 from £20 so do u still ask for these £12 charges back or would u say this is the rate for overdrawn cheers john

    Any Charges that appear you can claim back. OFT has not set any minimal limits as yet and not for a while either. This is Capital One's way of trying to look better.

  • thanks for that info warrior , going to send me second letter to them but do i claim interest now or add it on if i go to court cos claiming of tsb as well have added interest to that 1 but havent took them to court yet friday is there deadline b4 i do that cheers john

    I have just sent in my claim to Capital one and have added interest. I have read that if they settle before ourt then interest could be deducted. Is this right or do I hold out for the whole amount even if it doesnt get that far?

    Hiya - they're not obliged to pay you interest at this stage, just the refund of fees. However, it it reaches the court stage, then you can reclaim the interest (as well as your court fees)

    hold out for the full amount, its money you shouldn't have had to pay therefore you are entitled to the interest on your money that they have benefited from getting the interest on, so to speak.

    i am just starting a claim for around 65. including about 60 quid worth of charges, they can send me as many settlement figure as they want, but not settling for less than the demanded amount, the idiots sent me a second card and i got into trouble with that, so will go for that one as well after i have cleared the amount on both after they settle.

    Just to clarify - they are not obliged to pay interest on the charges before it reaches the court stage. Once you start a claim on MCOL or your local County Court, you can then start claiming interest.

  • hi all again lol forgot to mention when i wrote to cap 1 asked for my statements my wife asked for hers to but her account closed about 2 years ago got a letter saying cant find any records of her account any ideas wot to do now cheers john
