    Hi!

    I was given 2 offer for 2 accounts from Capital One, both the difference between the £12 and the actual charge. I refused both. One one account they put their offer up but I still refused it. I have put my claim in with MCOL now and am just counting the days down to hear something back.

    I have read on this thread a bit further back that other people have refused and started the court process then received cheque's for the full amounts so they will pay up eventually - its just a matter of sitting tight!

    I wrote to Capital One on 21.2.07 requesting refund of charges giving them the standard 14 days with my statements included. I have just received a reply today from C One stating that they have received my letter and would deal with it within 4 weeks of my letter:mad: . Now their original time runs out on the 14.3.07 (next week). If I don't hear anything within the timescale do I go straight to the 2nd letter threatening court or do I have to go to the ombudsman? Can anyone help?:confused:

    Follow your own timescale so yes send the second letter.

    Hi everybody
    I am in the process of claiming from HSBC, GE Capital and Capital One.
    Today i Got what seems standard letter from Cap 1, we will give you £74 cos we are so generous, even tho we owe you £280, go away you know nothing, be happy blah blah blah Bob udy.
    Ok i Need to send reply.
    I have seen Martins newest reply letter to send them, and couple questions ?
    What is the default amount, is it the total Inc the interest or only the charges they applied ( so the court works out the interest up to the day they pay up if and when it gets to the court steps) and do i still put the full amount in and basically disregard the Refund as it will be filed in later paperwork/claim to the court as payments received etc.
    I have sent all correspondence recorded delivery, any advise on if thats best way or email/ Fax etc
    I will keep posting as things progress

  • Got letter from them yesterday. Claimed £248 they repaid £88 straight back to card so not an offer. Want to try for rest through MCOL do need to notify them first as they have credited some back or shall I just go ahead?

    I sent off my letter 1 on 24th Jan requesting my last 6 years etc under DPA and recieved them today. I have added up my charges with interest and it comes to £912.66 , which is ok . My card limit is £400 but the charges spiralled out of control and i ended up owing £940.36 which was taken over by the DCA (Fredrickssons International) who collect for Capital One.
    I have been paying them £10 a week and have paid over £580 to them so can i claim this back as well with interest ?
    Could anyone offer me any help about this or what to do next Thank you

    rajesh121 Some banks dont charge, such as capital One and HSBC internet banking customers can view the 6 years statements online. In addition some banks return the payment but I would send it now in the event it is required or you may delay things.

    22nd feb Told my account has been transferred to debitas/capquest (same co?), who said they would send my statements to me
    1st mar Rang to check progress, no record of my call! Spoke to Lisa who promised she'd send them to my new address.
    8th mar Rang to check progress, Lisa not available, Eva said I have to ring capquest, who have to instruct cap one to send my statements. Held for 10 minutes for Lisa, who couldn't come to phone, but she sent a message for me saying she had sent them yesterday 2nd class. Conveniently. They will take 10 days. I'm beginning to think they will never materialise...

    Just send a letter saying you accept the £88 as a partial refund but you still intend to claim the rest and give them 7 days to get back to you. If they don't just proceeed with MCOL for the leftover amount.
