Either telephone them or write to them saying you do not accept their offer and give them 7 days to get back to you. If they don't just carry on with your claim as normal0 -
I had an interesting and very straight talking telephone call with the complaints department today on 0800 9525102.
I received the response to my first letter requesting charge refunds dated 5th march. I phoned up to see what had happened to the response to my second letter (I'm sticking tight to deadlines and sent that out on 2nd March) and apparently a reply to that was also sent out on 5th March (!).
The complaints exec read the reply over the phone and they are offering me part payment of £112 for my £295 claim. He basically said that judging by the way I was talking he could tell that I was not going to except this offer and that I should take them to court straight away - rather than waste time sending a response and then Cap1 sending back another response. (He mentioned that he and his colleagues have also been reading upon website forums as well as the public so he knew the direction this conversation ill be going)
If he had his way he would settle the full amount now but they are under strict procedures. He did say he would check with a manager to see if he could settle over the phone - the manager said "no".
SO MCOL here we come - my first one!0 -
I have a moot question.
I realise that a DSAR request only goes back six years, but what if you have kept statements further back than this (I'm sad - I know) and have charges dating back to 1999!!! Can you claim back this far? Surely the unlawfulness remains despite the age. I have just sent my first letter off to Capital One listing all my charges on there - they amount to over £500 with interest.Debt and Mortgage free date March 2014...0 -

Get the paperwork and copies of all correspondence and file with your local County Court. Will cost you £30. (Which you claim on the form)
Sooner you get the paperwork in, the sooner you will get your money back

I have now sent Capital One a 4th Letter thanking them for their offer but not accepting it and in the last few moments have started the mcol process.

They will get notice of the court action anyway, however by giving them notice that you have gone to the court stage may increase your chance of an early offer!
Thats the only reason why I have sent them a letter saying yeah thanks but no thanks, I'm going to court....0 -

I would just leave it up to the court now - they've had their chance to deal with you0
