Christr11, I think what they'll do is send you an incomings and outgoings form. You fill it in to show them how much you have left over after you've paid for everything you need each month/week, things like food, bills, rent etc.
If you can't afford the £50 they're asking for they should be able to see that from the information you give them and they should make you a different offer.0 -
... And now for a question of my own! How long did it take for people to receive their settlement cheques from Capital One? I sent my acceptance letter back to the FO on the 10th Oct and it's now the 10th November and I haven't heard a peep from the FO or Crap One!0

I have just developed a bit of money and have decided to payoff and close my capital one credit card - and because they have recently raised my interest rate to something unbelievable, I am going to reclaim all my charges too - may even leave just the amount I'm claiming for on the card, so they can negate it themselves.
My charges come to £400 - but there is one fee that I'm not sure if i can legitimately claim for - they call it a 'cash advance fee' - it was for £78 (on a 2.2k cheque to the inland revenue).
this would up my claim to £470.
I have searched for info for what charges can be reclaimed, but cant find any reference to this Cash advance fee - please - can anyone advise?

I sent 2nd letter off to Capital One claiming around £220 quid on 03-11-09, this letter was sent 1st class recorded delivery and was signed for @ Capital One on 04-11-09 as I checked on The Royal Mail website.
I have counted 14 working days from the day the letter was signed for which makes the 24-11-09 I should receive a response...
What is other claimers experiences with Capital One when asking for your money back? Do they go right up to the 14 days before responding to you?
Should I go stright to the FOS or send them another letter demanding settlement within 7 days if they breach the 14 day rule?
Any help/comments would be gratefully received...0 -

My claim was for capital one throught the ombudsman, my letter said if i havent got the refund from them within 6 weeks to contact Capital One.And yes the lady in the avatar is me

Was the letter you mentioned from the Ombudsman or one you sent to Capital One?
Did they ever respond to your original request to cough up?
I had to ring them to ask where my statements were in the first place, looks like i'm going to have to do the same for my refund...0 -

Ditto lol! I received my statements and the above only on Saturday just gone. Funny how they dated it 18 Oct 2009 yet the letter was postmarked 19 Nov 2009.

I finally received an offer letter today from Capital One!!! This I might add was the 14th day on which they had left to respond, cutting it very fine I think....
Anyway I claimed £160.00 charges £58.78 interest totalling £218.78.
They offered me £160.00 (Default Sums over £12 in full) & £10.00 as an acknowledgement of interest I may have incurred, making a grand total of £170.00. Leaving my claim short of £48.78...Oh and this was made as a gesture of goodwill (That’s what they added to the letter anyway)
They still state that they have reduced all their charges to £12 following publication of the OFT recommendation...
I thought that the OFT only recommended the charge as Capital One's letter states; it doesn't mean that, that is what they can actually charge?
What does everyone think, should I accept or carry on via the FOS for full refund?0 -
Any advice would be gratefully received....0
