Help,
Abbey have just written to tell me they are defending the claim on Moneyclaim and that the details of how I calculated the £4025 claim (ex-interest) should have been submitted when I filed the claim. I have looked at money claim and cant see how you do that!!
I was thinking of sending a letter to Abbey stating that I simply calculated all the charges they made to my account over the last six years and that I obtained all that info from them so they woudl have it anyway!!
Is anyone else at this stage or further?? Can someone give me some advice??0 -
HI EVERYONE,
I sent my letter to Abbey, asking for 6 years statements, 4years and 10 months came from Microfiche fies and told me what i needed to know. However the last 14 months were covered by duplicate statements, with no mention of charges and just the occasional line saying "interest charged while overdrawn". On the original statements, of which i have a couple, there are £120 of charges, however these do not show on the duplicates.
I went into the branch and asked for another copy, was refused as "computer says no". Phoned the call centre and was promissed duplicate statements with all charges listed. These arrived this morning, once again, the charges are not detailed.
Any advice from other Abbey Punters?????
So far i have £2500 to claim back, but i know there will be another £5-600 in the last 14 months that Abbey are trying to "hide".
Should i start a claim for the £2500 and then go back for the last 14 months???
The 40 days are well and truly up, but i want to get this up and running asap, any help would be greatly apprechiated.
Cheers

THank you for that Rex Mundi.
The 2nd letter I sent acknowledged the goodwill gesture of £50, (which has already been placed into my account) but I want the full amount back and they have 7 days etc... but it wasnt without prejudice though? Should I send a further letter making it more clear before proceeding further? Or have I shot myself in the foot now?
Getting a bit anxious now seeing some of the other comments about Abbey...but dont really want them to get away with it0 -

After the intial claim letter, they offered me a goodwill gesture of £50, paid directly into my account, and more or less said that's it!
I have written the second letter threatening the small claims court, but I would like to know if anyone else has ignored this 'goodwill' payment and followed up with the threat? Can you please let me know what your experiences are?
 I've had this letter too except I claimed a slightly less lowly sum of £523 and got £35. Who's working these figures out then?? I can think of several gestures I'd like to make to Abbey at the moment and despite the season, none of them are of goodwill.:rotfl:
I'm definitely doctoring the CAGs settlement letter and getting the rest.I have plenty of willpower - it's won't power I need.

If you haven't made it clear yet. Write to the bank again and be very clear to them that you will not accept conditions with the £50, and you will be continuing your claim for the rest. As long as you are very clear, and have this in writing (send it recorded/registered delivery), you should be OK.How many surrealists does it take to change a lightbulb?

Im telling everyone I know about this. When I first mentioned it to them they all thought I was making it up but since it has been on TV they all believe me now and are pursuing there own ones!!!
Talking of gestures.. I've had no response to the 2nd letter or at least I though I hadnt until it came to paying for some Christmas things today!!! Merry christmas to them too!!!!!
Good Luck too bizzimum...0 -
empem - does this mean they've closed your account?!!:eek:I have plenty of willpower - it's won't power I need.

Or have they paid up in full? I am working on the assumption that if it costs them £35 to send out a computerised standard letter it would cost thousands to defend the case in court.:rotfl:I have plenty of willpower - it's won't power I need.

I am at this exact same stage. I think we can just ignore this letter-- after all, they have details of all the charges already (they sent them us), and we are claiming interest at the rates we stated when submitting the claim itself.
We are not obliged to do their work for them. It would be very nice of us to send them the information, but I'm sure they have calculators.
Am I right, anyone?0
