Oh god no, i'm not pulling any kind of scam, it's an oversight and nothing more. I changed my address at other relevant places (like my CC, for example) just for some reason neglected to do my bank.0

I have been very silly over the last six years and reckon my bank (Abbey) must have taken at least £5,000 off me in charges over that period of time.
I have asked them to release all the past statements and have even paid them £10 for the pleasure, however I have not received them yet, (payment was taken from my account on the 04th Oct 06).
Two questions;
I currently live in Northern Ireland and the maximum is capped at £2,000 through the small claims court, , could I use a relatives UK address for the next 6 months and go through a English court or use the Moneyclaim service instead to claim back the full amount?
How much time should I allow them to send out this information as in their reply they said that as the microfiche records are not covered by the data protection act it is not subject to the statutory time period of 40 days.

I wonder if you could give me a bit of advice please as to which way to go next ...
I have got 2 accounts with Abbey -
1st account has been closed - this has got charges of £516.32 inc interest, I sent the 'letter before action' on 21/11 and received a response back offering £120.00
2nd account is still open - this has got charges of £2716.77 inc interest (and still growing ..). I have received a letter back offering £1084.00, so I replied rejecting this offer and they sent me the standard letter saying they will look into this and should reply within 4 weeks.
So now should I ...
a) Make a claim for both accounts with the total due as of today or
b) Make a claim for 1st account and Send the 'letter before action' for 2nd account or
c) Send the 'letter before action' for the total amount for both accounts.
Sorry this is long winded, I would be really grateful for some help ....

In March 1999, I paid myself a few days late. Concerned that my bank should be aware, I rang them. Abbey's call centre staff confirmed my overdraft facility was secure. However, Abbey's computer withdrew it, resulting in a spiralling debt of bank charges peaking at £125/ month from letter charges alone. I froze the account in Jan 2000 and paid them back everything except the bank charges. I beleived the charges to be due to their neglegence and refused to pay them.
Before the matter could be resolved, they sold the debt to Wescot credit, around March 2000. I refuted the validity of the debt with Wescot and all went quiet for 4 years. Now that 6 years is up, they are again chasing me for it.
I've only just found this site and am worried I may have missed the boat for reclaiming charges from Abbey and settling the debt.
So, some qustions for those in the know are..
- For a start, where do I stand legally as far as the time period?
- Can you reclaim charges on an account that is no longer active ( I have repaid a credit card debt but wish to claim charges for letters etc. during 2003)?
- And what of the debt that Abbey sold to Wescot credit?

Hi,
This is the first time I have looked at this forum after seeing GMTV yesterday and something strange happing to me over the last few months with the Abbey and therefore need some advice.
I called the Abbey in the month of October about charges coming out in October totalled around £100 I said I could not pay them being pregnant and partner just left me I could not afford to pay them as simple as that. I was told as a good will gesture they would let me off this time and only charge me £35.00 which I paid
In the Month of November I got my statement and again charges of £100 were on my statement again I called "but got the wonderful call centre) and said that since my last conversation in October with the Abbey I had tried not to occur any charges however I think going overdrawn by £12 for two payments of £8 and £4 did not warrant £60 charge I was not willing to pay this. Nothing the could do, basically said tough and increase my overdraft which I have done on occasions in the past to pay there charges. I said no I was not going to do that again! Annoyed as talking to their call centre is like pulling teeth I emailed a complaint. As the date for the charges got closer in fact they were taking it out the next day I called their complaint section and the lady logged another complaint but said I doubt you will get your money back we are within our rights etc...
Well over a week ago a got a letter thanking me for my email and as a good will gesture they would refund the £80 this time but no more!
On Monday I got a letter saying thank you for your call we will refund £680.00
Thinking abbey had made a mistake on their letter, I called them and I was told ok so you’re accepting the offer. Clapping my hands together because I have probably paid them £6000 in charges in the last 6 years I was going to snatch this and the money has gone into my account today. Well who wouldn’t your only complaining about £80.00 and here they are saying £680.00 with no explanations as to why they are refunding this amount accept as a Good Will Gesture.
THEN I watched GMTV and seen all the hype on charges and people now claiming their money back I am confused as to where I would stand.
Any help or advice would be much appreciated.0 -
If you intend to claim all your charges over the last six years, I would write to Abbey regarding the £680 offer. Do it in writing so you have proof of what you are saying to the bank. Say something like..............
I am now aware that these bank charges are unlawful under contract, and common law. I intend to look into the total amount I have been charged in the last six years. I will not accept your offer of £680 as full and final settlement of any claim I make regarding my charges. I will accept your offer only as a part payment, and without prejudice.
Then follow the steps in Martins article regarding reclaiming all your charges.How many surrealists does it take to change a lightbulb?
