I have recently sent off claim letter 1 to FD for charges they have scammed from me over the years. Their 2 weeks is up on the 5th......and we will see what happens.

I got my last 6 years of bank statements from the Abbey today, and after a rough going through them, they owe me in the region of £2678.25 (I am going to go through it real detail with my accountant girlfriend later, and do the letters).

    I have a question:

I have been charged a bunc of times for cheques that have been refused to be paid out. £30 a pop. Can I claim these back as well, as I believe they are as unjust an amount as the OD fee charges.

    Thanks for help.
    FD claim WON!!!!
    Abbey claim WON!!!!

Many thanks for the quick response. I hoped so......

Lets see what come of all this!!!!

As I have looked through all these and other statements I have noticed that although I was no genius with money, these charges were like a reverse snowball and they helped push me into the hole I have been drowning in for so long.

  • HI, I am new to this, I sent my first letter off to my bank (Abbey) on 26th November. On the !st December I had a reply consisting of 12 months statements. I rang them to ask why I can not have a list of charges, they do not do it, They will send me statements for the past 6 years and they told me there would only be one charge of ten pounds. Has any one had this experience? as I really dont want to receive I years bank statements every month.

any advice will be most welcome

I had to pay the £10 fee which is for the data protection fee.

I seemed to have been lucky as the Abbey sent me the last 6 years statements in one package. Having looked through them I am thinking that the reason they seem to be so reluctant to send out the info is the slow realisation that they have been caught out being naughty with charges for just about everything.

I added mine up today and was shocked to see that over 4 years they helped to make me worse in debt by amassing £2678.25 in charges!!

  • I sent a letter to Abbey saying that i wanted them to refund all the bank charges they have charged me over 6 years (£2800). I received a letter from them today but it seems like they are trying to delay the process.

Thanks for contacting us. One of my colleagues will be responsible for investigating your complaint and we will do everything we can to resolve your complaint ina timely and satisfactory manner.

I know its important to you that we resolve your complaint quickly but we want to do a thorough investigation and somtimes this can take time. We'll write to you within the next four weeks to let you know wahst happening.

    Yours sincerely

Should i continue with court action action once 14 days has elapsed because thats what I stated in my letter would happen or should i wait until they contact me?

Are you claiming every single charge levied over the six years is contrary to the terms and conditions governing your account?

Ok, then 14 days is more than enough.

But you will have to demonstrate to a District Judge that the charges were indeed contrary to the terms and conditions governing your account.

Abbey Nat will issue a full defence to the claim as a matter of course to try and intimidate you............you should expect this.

But if there are any holes in your claim................

Good luck, if you need any further help don't hesitate to pm me.

VeronicaD - i had the same letter saying they wanted to carry out a full investigation. They did get back to me but it basically said tuff we aren't gonna pay you back, and if you try and complain we may close your account.
I wrote back saying that i had considered their threat carefully, but that i still wanted my money back, or i would take them to court.

They wrote back offering me £112, on almost £1200 owed. Naturally i have now taken them to court.

Things are now getting confusing. They acknowledged my claim, and said they were going to defend the whole amount. This gave them 28 days to enter a defence. On the 29th day i went to court and filed for a judgement, as they had not entered the defence.

I have now recieved my judgement from the court - i have won by default.
However, Abbey sent their defence 2 days late. The court has now told me that they can apply to have my judgement set aside, and can defend anyway.
