    In both these cases, the bank needs to comply with your rights under the Data Protection Act. If you have made your first request (subject access request) using Martins template (or the one at CAG) asking for your last six years data. They MUST comply with your request for your data within 40 days. If they fail to comply within this time limit, you can report them to the information commissioner. Before you report them, you can write to the the bank using THIS TEMPLATE giving them another 7 days to comply (this worked very well on Natwest). You must wait till the 40 days deadline has finished before you send this letter though.

  • hi all,

    I have put a claim in to the Abbey for charges, they have sent me a standard letter saying they are sorry i am unhappy, etc etc. They aim to investigate my complaint and respond within 4 weeks. Do i need to acknowledge this letter or take any action as yet?

    Just continue with your timetable. Don't wait for a response from them.
  • erm, I've made a boo-boo. I haven't changed my address with Abbey from when I moved house 6 months ago - they rang my previous address (I lived with my mother in law) and she grassed me up!

    Will this adversely affect my claim?
  • Here is my diary of my personal story of reclaiming my bank charges,

    I read through all the info i could find on this site and read and reread peoples storys and i thought 'i could do that'

    so this is where i am at

    i sent off my letter 2 weeks ago 16th november 2006, to request my statements, and today 4th december 2006, the postman delvered the most letters i had ever had through my door in one go !! with it was a letter stating that the 'rest' of my infomation is held on mircofiche and will be joining me shortly...

    so all i have at the moment is 14 months worth of data !

    quick totaling up, of just the 14 months..... £690.. not too bad, but i would imagine thats a small fraction off the last 6 years..

    i am doing this against the advice of my husband who 'doesnt want me to make a fuss' and 'everyone at the local branch will hate us' why i ask, as its not thier money i am claiming back but mine ?? so heres to me, working alone.

    PoochyChoo v's Abbey stage 1 half complete, just waiting for my microfiche data !!

  • She grassed me up by telling them i'd not lived there for 6 months :D Maybe grassed is a slight exaggeration
  • Well I suggest you let the bank know your new address as soon as possible and anyone else that is pertinant :)

    You must fill us in. Is there any reason why you wanted Abbey to believe you are still living at your previous address? It must be more than just an oversight as the previous letter must have come from your mother’s address. If you play dirty, they’ll play dirty: are there are a few skeletons in your cupboard you don‘t want the bank to find out about?
