  • HELP I have followed Martin's tips on this and my bank named and shamed the Abbey have refused to send me 6 years of bank charges they say that they can only send 14 months!!!! Please some advice do I go ahead and just settle for the 14 months or follow the next step and ask for the 6 years of reclaimed charge then the letter of going to court?
    Many thanks for any information and what to do next.....:money: :money:

    Have you sent them a letter or just phoned?

    Did you make it clear you are making the request under the Data Protection Act?
  • Well with the help of Abbey's £680.00 I’ve decided to go for it I have made a list of every bank I have banked with over the last 6 years. I take it you can claim on credit card banks as well? and I will send off my letters with the £10.00 enclosed. I have left my other bank alone - for the moment but I will peruse them as and when I need to, but these are my safety net as the Abbey are sure to try and close my account. If they do close my account I take it they will have to contact me to make some arrangement to paying off my £1400.00 overdraft? Which I have asked them if I can do but they have said no unless I want to surrender the account!

    and I have 4 accounts with MBNA do I send them £40.00 or £10.00?

  • Hi, in the early stages of my claim from abbey for around £200.
    I skipped the request of data stage as I had details of the dates and amounts of charges from statments.
    I have a £1.6k (graduate) overdraft and I accept they may choose to close my account at payment.

    I am now waiting for my local branch to reply with the standard brush off so I can take it further.

    Couple of Qs

    1) Is it ok that I left out the request of data held part and just stated I wanted the fines I detailed in my letter? I didnt provide proof to them, but obviously they know when I was charged. Im only claiming recent charges anyway.

    2) Clearly a £200 refund won't clear my 1.6k OD. On what kind of schedule might they expect me to repay this in?



    Ive just started working (on a modest but steady income), with low rent boosting it. So provided im not expect to make immediate repayment, I should be ok. Oh got my parachute with A/L just incase

    After the intial claim letter, they offered me a goodwill gesture of £50, paid directly into my account, and more or less said that's it!

    I have written the second letter threatening the small claims court, but I would like to know if anyone else has ignored this 'goodwill' payment and followed up with the threat? Can you please let me know what your experiences are?

    Hang in there... some good examples of replies in other areas of this excellent site.
    Have a look in 'Reclaiming Bank Charges' section.
    Nothing to worry about if you have never issued papers in the Small Claims Court, I have always found the staff very helpful.
    Having issued a number of claims, its well worth the satisfaction when you get your dosh. :D
    They almost always offer the token carrot until they receive the papers and realise their not dealing with a nerd.
    Form is they almost always settle before having to attend court.
    GO for it. :money:

    You MUST write to Abbey and let them know that you are not accepting this payment as a full and final settlement of your claim. Tell them that you would accept this as a part payment without prejudice, but will continue your claim for the balance of your charges. Do not just ignore this payment, the bank may think you have accepted their offer.

  • I have followed all the steps outlined for reclaiming bank charges but abbey have filed a 6 point defence and have moved to my local court in huddersfield. I have received the questionnairre but cannot find any advice on this site for what happens next please help urgent.......

  • good luck, nobody ever seems to answer this question even though a couple of members have been quoted as saying they would help in a thread about using recovery experts.
