    HI
    am at exactly same stage as you king7 am going to court for the papers this afternoon have to do it in court as am on benefit and dont think i can do the moneyclaim on line without paying am giving them no lee way they dont wait and give you a couple of days when slamming on the charges

    i just asked to extend over draft for 1 month cos 75 charges due out today and didnt have the money to cover it they charged me 25 to do this

    no way am i giving them any time atall

  • Hi I have written to my bank (named and shamed as the ABBEY) and asked for the statements for my charges, used the template kindly suppied on the website, and they sent me 12 months of ordinary statements and CHARGED me £10 for each statement!!!!! Then I wrote to them AGAIN stating to read the letter properly and that I am not paying for their mistake, they then said that they COULD NOT GIVE ME 6 YEARS OF STATEMENTS AS THEY DO NOT HAVE THAT INFORMATION but could only give me 12 months!!
    please help what do I do next or has anyone else dealt with the Abbey so that I can follow what you have done by reading back.

  • I've been through the whole process and have filled in a County Court Questionaiire, and sent that back, and have now received a date in court. I am fairly worried about this, as no one else seems to have gone this far. All banks seem to have paid out before this?

    Has anyone any advise as to what to do, or prepare for if this goes to court?

    Get in touch with the Information Commissioner. This is a clear breach of your rights under the Data Protection Act.

    You are not the first person that has gone this far. You need to prepare for court anyway, but chances are that Abbey will settle just before the court date. Some banks have settled just days before the hearing date.

    Hi all.
    Will this do for a follow up to Shabbey,s GOGW.

    I refer to default charges applied to my account amounting to £523, which I have requested you pay back.
    I wrote to you on XXXX, making the original request for a payment in settlement of my claim. I am willing to accept your goodwill payment of £35 as a partial payment of the full amount without prejudice. As I do not find your response satisfactory, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.
    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the Leicester County Court will rule in my favour.
    I have attached a full schedule of the charges with this document.
    I look forward for a full response to this letter within seven days, otherwise I will commence court proceedings to reclaim my money.

    (I'm tempted to add this :money: as my own gesture, but I won't:rotfl: )

  • Sent a letter with a cheque to Abbey over a month ago just asking for details of the charges over the past six years, and still haven't received a reply and the Cheque hasn't been cashed.

    I will call them tomorrow and enquire as to the delivery of my letter, if however they dont admit receiving the letter, a copy of it and another cheque will be sent recorded delivery.

    Im looking forward to going the full lenth with abbey but need them just to reply.

    I am at this exact same stage. I think we can just ignore this letter-- after all, they have details of all the charges already (they sent them us), and we are claiming interest at the rates we stated when submitting the claim itself.

    We are not obliged to do their work for them. It would be very nice of us to send them the information, but I'm sure they have calculators.

    Am I right, anyone?

    i started sending request letters to the Abbey on 23rd November for a closed account, i have sent all correspondance recorded to the main office 2 Triton Square in London, i am due to issue court papers tomorrow! i have just called them to see if they wish to enter into negotiations before this commences, to be told the complaints department do not have anything listed on their system, they claim they could open an investigation into the charges but legally this can take 8 weeks, i told them that i had sent everything to the TRiton Square address to which the lady from the complaints department replied they do not deal with charge matters we do and we have no record of a complaint being lodged.

    Have i done everything right? am i still okay to issue court proceedings tomorrow?

    Seeing as that's their registered address, they should at least be able to forward your letter on to the relevent department.

    If your deadline is up, then move straight on to the next stage.
