    What a fantastic forum, I have not used it before but I am a convert and will be back again.
    Now for the reason I am here, I am at the stage of final letter prior to the Court Case with Abbey Business Banking, on the checkbook the address is a P.O. Box in London, which is where the first letter was sent, the reply came from the customer service centre in Glasgow, I think it is better for me to deal with the London Office and the claim will go through the English Courts, can I do this? after all it is there official address on the Checkbook.

  • Be careful with the "2 accounts" thing with Abbey. A work colleague has told me that Abbey swiped money from a joint account, to pay off the unauthorised overdraft on her partners sole named account. Apparently they can do that!

    So I'm sure they can close 2 accounts if they want to.

    They're not allowed to take money from one account to put in another without specific written permission as far as I know. I'm in the process of sorting out RBS for doing just that and taking a charge for each time they shuffled it between accounts.

    As to closing a second account, believe me they probably will. RBS did it to me without telling me about my personal account after closing my business account and they dropped me right in it. DON'T TRUST THEM! THEY'LL DO THE DIRTY IF THEY CAN.

    Hi all,
    Re- Abbey, I also received the standard letter 'statements only held 14 months... others on microfische...' today I have received 14 (yes, fourteen) envelopes each containing one statement and leaflet of T&C. Now we know why they have to charge so much, ineficiency.
    Also I am claiming £450 from Barclays, I used the templates and advice, they have offered £241 which I did think to accept, but changed my mind am sending third letter today. Thanks for all the interesting facts and advice, it really is a minefield out there. Rene

    I also received a very nice letter from the Abbey,stating that they would be sending me my last 14 mths statements,which duly arrived last week.The letter also explained the microfiche system and an authorisation for a £10 deduction to send these.They also stated that they were not delaying tactics,so i promptly reminded them of the 40 day rule when returning the authorisation form.At present all correspondence is being promptly acted upon,but i aint claimed yet!!
    Mind £175 in 14 months so far calculated... Bring on the microfiche statements

    Happy New Year 2007.

    Thought I'd keep you informed. I got a reply from Abbey regarding my first DPA letter on 14th dec 06 & silly me I had made an error with the £10 cheque. I made it payable to Abbey instead of MBNA Europe Bank Ltd.
    Abbey returned the cheque back to me with a letter explaining the cheque details needed to be changed & before they could proceed I had to provide additional information. The letter or I'd say it was more like a form sent to me gave me 3 options to tick. I choose the option to provide me with a fully comprehensive data request list, included the £10 cheque plus thye asked for proof of indentity!!!!! Either a photocopy of your passport or driving licence. I've complied with their criteria and hopefully with any luck will get my statements. So what this space......

    Applied thru Moneyclaim Online for charges of £254 from Abbey on 15th Dec. They've now acknowledged the claim and I had a letter saying they intended to defend. However, they said that I haven't provided a breakdown of the charges or how the interest has been calculated.

    This I have done, several times. Once with the initial letter, once with the second letter and the last time was with the 3rd letter telling them I had started court proceedings against them.

    They are asking for this information to be sent to them. Do I just ignore them? Do I write yet again and send it yet again? As far as I'm concerned they have had the info they want several times over and all by recorded delivery.
    So what do I do now?

    As far as I can see from the way Abbey have been doing things, it's a stalling tactic. As they have had the info 2 or 3 times already, I would send them a letter reminding them that they have had this info 3 times in the last previous letters, and send a copy of the spreadsheets to them at the address they usually get mail. It's obvious they are stalling and trying to put you off by being bloody minded.

    I am filing MCOL against Abbey in the morning, and will be expecting exactly the same response. What I have seen is that people who stick the distance get messages and phone calls at the 11th hour with full payments being made. Being bloody minded must put some people off going the distance and that is why Abbey seem to be sticking to that way of doing things.:confused:

    The irony is that banks are waking up to the fact that they have been taking the mickey for too long, and are to blame (partly) for the hole alot of us have got into. I am thinking that a floor mounted safe under a carpet is as good as a bank, as the interest amounts to the same, and there are no "admin charges":rolleyes:

    The letter also said that they would like an email address or telephone number. I haven't given them either as I am doing this on behalf of my son who doesn't live with me. This is the postal address they are using. I dont see why I should give them email or telephone, I want everything they say in black and white.

    Send them another but make sure you tell them that its for the claim and put the claim number on the top of the letter. Also send a copy to the court allocated to you to add to your case file.

    Should I send it recorded yet again? I know its a paltry amount of postage but I'm getting a bit sick of keep sending the same information when they already have it.
    Can the price of postage be added to the claim too?
    I went thru moneyclaim online. I haven't been allocated a court yet. If they enter the defence that will be the next step I think although you'd think for such a small claim they would just pay up anyway. I have copies of all the letters i've sent them so far.
