    You don't have to respond to the defence in any way yet. You can, if you like send one more letter recorded/registered delivery that only contains the charges. Mention in the letter it is the fourth copy you've sent them. This may be a good idea, because this will be entered as part of your case to go in front of a judge if it gets to that stage (I doubt they'll go that far).

    Hello all Abbey battlers, I too have made this error, would it be in my best interests to send a revised letter today with a cheque payable to MBNA Europe Bank Ltd? I'm assuming the 40 days will only start from the day they receive the correct cheque. I thought it was funny I'd heard nothing from the bank, even with the stalling tactics... until I read foxij's post.

    ping foxij, you say you were asked to supply additional information, what, in general, might they ask for at this stage apart from account number and a request for a "comprehensive list"?

    Hi, this is my first post although I have been 'lurking' for some time.

    I am about to start my claim from Abbey for just over £2,500.00 bank charges including interest (thanks to the interest calculator!).

    After reading a lot of other member's posts it seems I got my 6 years statements fairly painlessly, I just phoned and asked for them, they sent me 14 months worth with a form to fill in asking for the previous 5 years, paid the tenner and received them approx. 1 month later. I get a sneaky feeling the rest isn't going to be so easy!

    I'm a little confused with a couple of charges and not sure if i can claim them back so I have listed them below - if anyone can give me a 'yes' or 'no' I'd be most grateful - thanks.

    'Unauthorised O/D Fee' - which increased from £15.00 in 2000 to £16.50, then £20.00 in 2005.
    'Cleared transaction' - which increased from £9.00 in 2000 to £10.00, then £15.00, then £20.00, by 2005 it had reached £30.00!

    Can I claim for both of these, even when the charge was only £9.00? Each time both of these were charged for one transaction there was also an Interest Debit which I haven't included in my calculations.

    Yes I believe you can claim for both of those.

    You cant use the this calculator at this stage because this works out statuatory interest which can only be used once you file a claim with the courts.

    You can include overdraft interest at this stage but only if you can show it was solely caused by the charges.

    Hi
    just an update my friend is still waiting for his statements, but has written back to abbey saying that he will accept their 'good will gesture' as an interim payment pending receipt of his statements.
    They wrote initally to say he had to pay £10, he naturally assumed they would debit his account, is this not the case?
    The bank have put £400 pounds of the £1200 into his account, but as we've had the xmas hols its all been a bit delayed

    If your friend didn't attach a cheque/PO when sending off for his statements they may well debit his account of £10 as they are entitled to do so.

    ive got the cheque ready along with letter template for reclaiming (on my wifes behalf):rolleyes: i reckon without interest a GOOD couple of grand!!!!!:T...
    just one question do i mail it registered post:j

    ps its abbey national plc :eek:

    shall keep you all updated on progress:p

    i just love taking on the big boys ive done it many times before with employers and not lost one to date:T :beer:

    although it clearly states show all charges for this that and the other just read a post where they replied but omitted all relevant info thus pretty useless.

    can i reword it to politely ask exactly what i want and the fact i will accept nothing less than what im asking for:j

    read someones post they sent cheque made payable to abbey and its was returned should have been made payable to mbna:o


    do i make cheque payable to abbey and send it registered as its day one of letters today.well later on today that is:rotfl:
