    Hi Ive had my account with Abbey for 6 months in that time they have charged me £50 a month every month for going overdrawn by as little as £2 a month, they won't give me an overdraft and due to the initial £50 they charged me for goign £2 over it has just spiralled, I want to claim this back now £250 in six months. Is this do-able? Will they close my account? Has anyone claimed from Abbey at all?
    also I don't want to make them mad as my mortgage and ISA is with them too

    Yes, you can reclaim the charges, read the articles at the top of the forum, next to 'Start here'.

    They may try and close your current account so you need to open a parachute account. They shouldn't touch mortages, loans, credit cards etc, as these are covered by seperate legal agreements.

    i had the same problems, i started to phone them and complain about a year ago. i would tell them that the charges weren't justifyable so the first 2 times they gave me full refunds then after that they would give me £30 of the £50 back with a story about how they wouldn't be able to do this again within a twelve month period, but they have done it time and time again.

    Started my claim but didn't realise that i had to write to Abbey first. Was not aware until i joined this forum. Anyway I have the AQ and have agreed to a months period to negoistate with Abbey. I intened to write to them asking for my charges and also for charges form last couple of years has didn't realise could claim that back has well. total claim is not that much less that £700.
    Does any one know if i have lost out due to not sendiong 1st 2nd letter?

    I have had a letter back from abbey saying they are going to file a defence. We filled out the money claim form on line and paid the fee now abbey are asking for details of how the interest has been calculated. they also say this shouldhave been sent to the court. I did send the two schedule of charges to the abbey previously. can anyone advise what I should do.
  • Their just stalling for time. As long as you have sent the details of the charges and how you have calculated the interest it'll be fine.

    Hi all,
    My first time to the site. I sent off my first registered letters to Abbey, Halifax & Smile. I did get replies from Smile and Halifax but nothing from Abbey to acknowledge my request for Data Protection Act. Shall I sit tight with Abbey or chase them on whether they have received my first letter or give them their 40days to produce my data then act??
    Also my 40 days on 26 Dec 06 are bank holiday dates included or not??

    Give them 40 days then if nothing, write to the Data Commissioner and Abbey informing them they are in breach of the DPA and you will enforce through the court if necessary.
  • Hi,

    I have a single and a joint account with Abbey. I am only going to try and claim charges on my single account for now and are quite happy for them to close it if they want but I don't want my joint account to be affected as this is my mortgage etc. Our mortgage is also with Abbey, can they be funny about the joint account and the mortgage if I go ahead with my single account claims?

    Thanks for any advice you can give.
