Yes, someone went to court and lost about a year ago, he wasn't prepared enough, unlikely that scenario will happen again.

Recently in NI, someone went to court and lost because the defendant Citibank introduced an expert witness. It's currently under appeal. See here for details.

Others have done exactly what the banks want and backed out before filing a claim (i.e. giving up after being refused a refund), but by and large you will get your money in the vast majority of cases.
  • i received my statements in seperate batches, i then post letter of charges to them and have dne the 2nd 1 but so far they have failed to acknowledge either of them:mad:
    relynutz says it all :o
  • Be careful with the "2 accounts" thing with Abbey. A work colleague has told me that Abbey swiped money from a joint account, to pay off the unauthorised overdraft on her partners sole named account. Apparently they can do that!

So I'm sure they can close 2 accounts if they want to.
  • I'm just going to use my fiancees account to have my wages put in if Abbey play dirty.

The NI is under appeal and is with the judge this week for a further hearing. There was no expert witness just a load of figures produced atthe last minute with the claimant not having access to them. The claimant did not in fact lose the case as he had already been give nthe difference between £25 previously charged and £12 which Citi for some bizarre reason think is the new figure they can charge.
Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.

Did it not turn out the 'expert witness' was their Finance Director who was the one who compiled the breakdown of costs?

    many thanks
  • Hi, newb moneysaver here. I have been worrying over some bank charges recently, and after hearing the tips on the bbc radio2 show that outlined claiming back charges i have decided to commence the assault upon the "Shabbey" national; Sorry, its just the "Shabbey" these days.

Ok, i went overdrawn, unauthorized about 4 months back, by £4.50, through a direct debit and have been charged accordingly. I was initially charged, not informed and did not find out until a statement came through the door a month later. My lack of insight into the account was due to me switching account to the Nationwide. My main question is, what should i do. I was under the impression that a call to the bank expalining what had happened would be sufficient, however i have realised that the claims are for far extending charges over six years. I will have been charged over that time, so do i first pay these charges, and try to reclaim, including past charges or what? Please help.

    Kind Regards
    David
  • I started to panic when I was reading about they will close your bank account, I have my husbands bank account waiting in the wings for when they start to get dirty
