    Just to reply to your post about Abbey's defence, I'm also at this stage and their defence was sent to me and it had, like yours, a bit that said "the Defendant denies that the Claimant is entitled to claim any charges alleged to have been incurred prior to 23rd February 2001 by reason of the Limitation Act." That doesn't apply to me because all my charges are from March 2005 or later, so I'd guess that Abbey have put together a one-fits-all defence and sends it out to everyone! Typical cheap-skates! If you haven't already, the court will transfer your claim to the court nearest you and you'll be sent an Allocation Questionnaire, tips for filling in which can be found at various points within this thread.

    I have sent the £10 to Abbey data protection address and they have sent back 9 months statements only. If I am entitled to 6 years worth of charge details, how do I force them to send the full 6 years as acceptable by law.

    Abbey have rather ungenerously decided to acknowledge our claim today, coincidentally the same day that they had to sign for our response to their investigation conclusion (conclusion: we are very silly & they won't be putting up with any of our nonsense). Now we have 28 days as I understand it before we know what their next move is to be. Our claim with interest is for £2800ish, has anyone heard of recent success stories with the Abbey? Have been trawling the boards daily, but it seems that we've chosen the pre-ghost Ebenezer of banks :p

    Quite happy to take it all the way, though my fiancee is less confident, but am worried about the forthcoming ruling. Solicitor friend believes that it will not affect cases already filed; can anyone confirm/refute this?

    Keen to take this as far as we can as 99% of the money taken was following my fiancee's accident when money was really tight & they never gave us any leeway even on the two occasions when our card was cloned & funds removed, they still only reduced charges to half. Would be a very happy girl to see them pay!

    Trying to help son reclaim all his charges from Abbey £2300. Have sent 3rd letter stating court action next step. Received standard letter today 'I am so sorry that you have been so unhappy that you felt you must complain. One of my team will be responsible for investigating your complaint and have enclosed our complaints leaflet! ........... We will write to you again in 4 weeks time.' etc
    Do we go ahead with the court process when the 7 days are up. Sorry if this is a repeat but want to do this right if we proceed? Won't back down now.
    Other son with Natwest and he has had a verbal offer of £100 lower than what he was claiming but hasn't got it in writing yet.If not received by tomorrow he will continue with court process.
    Any help gratefully appreciated and you are really thanked for your help and support. People power has a lot going.

    Not all manual interventions are recorded, for example when a memeber of staff looks at a paper document relating to an account, a record is not always required. similarly some interventions may relate to work carried out by a department rather that individuals where no central record of activity is kept because this is not the kind of information we need, or more importantly, that a customer would usually request.

    I had the exact same letter from Abbey. You will probably get the rest of your info in the next 1-2 weeks. Mine came on A4 sheets, 55-60 of them.:rotfl:
    The charges are usually taken by Abbey somewhere around the 28th - 30th of each month and will show as "unpaid d/d charge" and then "chg" and then the amount. Abbey were charging £30.00 in 2001 and then £32.00 up until 2006 and then £35.00.

    Did you get a letter saying some would be paper, the rest would be from their microfiched stores?

    I assume you sent the template letter from here asking for the past 6 years?

    Yes, keep to your time scale, not theirs. They are just stalling.

    Do you mean you have sent the 2nd letter from here though and are waiting on a response from that? I ask because that letter says you give them 14 days to respond.

  • Hi Yes he will accept but only when confirmed in writing. Have to say he is very good at tackling his bank when they try to charge him but now wants what he is entitled to for past charges. At present he is giving them till Friday to receive written confirmation or go to court.
    Thanks for the comment to go through with Abbey via courts.This son not so confident and his charges incurred whilst unemployed for 11 months. Abbey were not helpful at all at the time. When he received his statements again like others have already documented here, they were without balances recorded only what had gone out of his account and the codes, DD, CHG, SO etc. What really annoys me is that in our local branch there are 3 deposit machines and only 1 withdrawal machine. It's our money they are holding onto to and then charging us again!
  • Sorry Bakeybadoo. No sent 3rd letter from ? and did give 7 days notice but as that's nearly up so proceeding to court process.
