I've been totting up charges from abbey on an entirely inactive account for over a year now and have done nothing. i didn't have the initial £35 and i certainly don't have the few hundred that it is now.. i have moved around lots, lost all account details, then came back to visit parents who had old statements and i realised i'd totally forgotten it existed..
i just don't know what to do!!
at one point when i was using the account acouple of years ago twice i was charged £35 for a direct debit of £2 to the nspcc that i didn't have.
if i ask again it'll be the 3rd time i request statements..
goodness.. i'm a musician for goodness sake, i'm not made for banks and forms.. once i sort it and get rid of it \(i'm praying i can..) it's pennys in a jar from now on!!!
any advice would be much apreciated... can i request the charges be withdrawn on the grounds i haven't been near or by an abbey for well over 14 months or so...

You can reclaim the charges on the grounds that they are unlawful and thats all you need to say
You dont want to be requesting statements though. they will charge per statement for these and are entitled to do so. You need to write a Subject Access Request under the Data Protection Act and pay the statutory £10 fee for a list of all charges on the account. Use the templates on the main article here :

If they dont provide them within 40 days they are breaching the terms of the act and you can complain to the Information Commissioner about the delay. As you will see from posts about them Abbey are a pain to deal with but do claim back what is rightfully yours and good luck0 -
Sorry if this has been answered before but i'm new here.
I wrote to Shabby on 3rd March with first letter and cheque for £10. I didn't send by recorded delivery which was silly i know. They have not cashed cheque and i have heard nothing at all yet.
Should i send first leter nad cheque again via ecorded delivery?
Also, do i just make the cheque payable to Abbey?

Is the fact that I am now claiming a reduced amount (because the full amount was over £5,000 and I wanted to go through small claims) likely to cause me a problem if I just send them the original claim and interest calculations, as this is obviously different from what I am now claiming through the courts?

my original claim was for £5587 and i dropped mine to £4900ish by reducing each charge by £2.50 (which a judge agreed with in a recent court case) for the amount i felt i actually cost for a stamp and automated letter (probs much less more like) then went back on the interest calulator and totted up each charge again minus the £2.50,this is the amount i will be sending them in the 7day court action letter which goes out on tues.
So maybe this is one way you could reduce the amont below £50000 -
on 23/2/2007 I posted the dpa requesting 6 years of statements from Abbey and that deadline isnt up until 6/4/2007.
i recieved a letter of acknowledgement from them dated 8/3/2007 saying that I should recieve 14 months worth of statements within the next 5 - 7 working days, and they haven't arrived. And also that the previous information is stored on microfiche and it is not possible to provide me with a computer print out of this info. But they have made arrangements to send me a list of archived transactions between 2001-2005 under seperate cover.
the letter then goes on to say:
with regards to 'manual interventions' that may have been made on the account. we regard manual intervention to mean an action that is not automatic or computer driven.
Not all manual interventions are recorded, for example when a memeber of staff looks at a paper document relating to an account, a record is not always required. similarly some interventions may relate to work carried out by a department rather that individuals where no central record of activity is kept because this is not the kind of information we need, or more importantly, that a customer would usually request.
Are they just talking !!!!!! or am I missing something.

i sent the first request letter to Abbey CC by recorded delivery on 23/2/2007 requesting charges plus intrest totalling £351.01 giving them the 14 days.
Had a reply dated 2/3/07 saying that they are investigating my complaint and will give me a full response by 25/3/2007 giving themselves an extra 13 days.
I know I should have stuck to my guns but I have had a lot of family worries and fighting abbey was not a priority at the time.
But today is the 26/3/07 so do i just send the 2nd letter with the 7 day warning now?

simple question: which address do I send it to?? the one on the chequebook?
EDIT: just reaslised that the cheque book address is a PO Box, I would like to send it recorded, so will need another address. dont want to send it to my local branch.0 -
My letter requesting 6yrs info was received by Abbey on the 12/3 RD. I read somewhere that they have 40 days to respond, is that correct?
I would like to chase them by telephone but I dont want to use the call cantre in India as they will not have the info I require.
Does anyone have an appropriate number I could call and has anyone else followed up with phone calls.
I have held off doing this as I would be really stuck without my bank account. I have tried to open a parachute account, A & L said yes middle of last year but without debit card (am not asking for credit but could not run my life without one) and Citi just turned me down for their basic account. I should add here that I had to turn to CCCS end of 2005 so my situation is tricky. Bit of a catch 22 really, money back would help but might have to forgo because of debt
Am hoping that as my mortgage is with Abbey as well they wont want to close bank acc down lol.

We called the number of the place that wrote back to us advising we'd have 12 months of paper statements and the rest would follow from microfiched records.

Well, probably not much help but Co-Op Cashminder gives you an Electron card if that's any use?
It's best to just get any basic account for now, just incase, if they do close your account, you at least have somewhere for money to go in and out of whilst you look around and apply for maybe an account with better facilites to match your requirements. It means you aren't stalling in getting on with reclaiming.
Any of our charges would be swallowed by the actual debt but I figure it's fine, I'm still taking a stand and it's paying the money from the debt which went up and up due to their greedy charges.:: BCSC #71 but now discharged! ::0 -
