    Yes.

    You do not have to give them any further warning. You are setting the time scale, not them. They've had plenty of time already and even broken their own reply date!

    Are they just talking !!!!!! or am I missing something.
    I sent the template letter from this site, has anyone else had this kind of letter?
    Yes, I had the exact same one. It's pretty standard it appears.

    The microfiched stuff appeared 2 days before the 40 days were up. Sh(Abbey) are terrible for stalling.

    First off, I'd call them and ask if they received your letter and the cheque. Might be they have and it's in their system and they are just stalling until the last minute.

    If they have it, continue to give them the 40 days.

    If they haven't got it then ask them to cancel the cheque and then re-issue another letter and a cheque (made payable simply to 'Abbey') and obviously send it recorded this time.

    i typed all charges,dates and reasons up on excel spreadsheet sent them that with copies of the statements with the charges highlighted
    I just wrote them in the letter, as they appear on my statements.

    I've obviously kept the originals.

    Wierd, but i just rang home and told there is a pile of letters from Abbey lol. I'll get them opened tomorrow. Checked my account online and they have not cashed the cheque as of yet. is this normal? Also how long is it usually for the rest of statements to turn up. Any help gladly appreciated.

    My friend is claiming her charges back from the Abbey. She is owed £4k they have just sent her a letter offering £300! Obviously she has refused this but they have said they will still pay it into her account and she can continue with court proceedings. Does this sound right to anyone???

    Well they can cash it whenever they please, so long as the statements arrive within 40 days, I wouldn't place too much worry in when it clears.

    The microfiched ones turned up on day 38 so I think they are just stalling people.

    Yes. Pretty standard to get a partial settlement.

    She just needs to continue and insert a paragraph saying that she accepts x amount as partial settlement but still intends to procced with claiming the rest.

    i have had a payment in to my account sent them a letter saying i will accept it as partial payment 'without prejudice' and will continue with court proceedings to recover the rest of the money owed to me

    Yeah true im not bothered when they cash it though im damn sure they will.
    Well hopefully i'm now on the right track , thanks for the advice i'll keep you's informed of any problems etc , as i'm sure it'll be a long battle.
