  • Does anyone know what I should do?

    I'm new to the forum and I hope somebody out there can give me some advice. I've been going through the process with Abbey and I'm at the court stage now where they have said that they are going to file a defence.

    My original claim was £5,890 but so I could go through the small claims court I dropped it to £5,000. I'm going for the interest as well so I just calculated the reduction in interest by the same drop in percentage from £5,890 to £5,000.

    They've just sent me a letter saying that even though I have already sent them my claim amounts (the higher figure before I dropped it to go to court) they want me to send all the calculations of how I came to the amount I am claiming, as well as my account number and contact details. They don't have access to my original correspondance and they are preparing their defence.

    Do I need to send them this information again?
    Does it matter that the amount I am claiming in court and the way I have calculated the lesser amount of interest is different from the way I presented it when I first started the process?

    Does anyone know what I should do next - I've been going through the same delays with Abbey that I've read from many other threads but I've not found this same scenario anywhere.

    Even although you have already sent this information just send or fax it again to keep them happy! Seems to be another "standard" letter from the banks or their solicitors as you can read here...

  • Thanks so much for that. I was a bit worried.

    Is the fact that I am now claiming a reduced amount (because the full amount was over £5,000 and I wanted to go through small claims) likely to cause me a problem if I just send them the original claim and interest calculations, as this is obviously different from what I am now claiming through the courts?
  • I staked my claim with the wonderful Abbey, using the standard letter thanks to Martin, sent it by recorded delivery and a week later I received the letter that everyone else has...We are sorry you have had cause to complain..looking into it...will take up to 4 weeks...etc etc etc...Now this may have been answered earlier in the thread but after 6 pages my eyes were boggled!:D but what do I do now? Do I wait 2 weeks and then write again using the next stage template or do I wait the 4 weeks?

    Luckily I'm a hoarder and kept the 4 years statements I was with them. (something must have told me that I may need them one day)Abbey owe me the sum of £2441.41, I was amazed when I found this out using Martins interest calculator, and its all thanks to the Tax Credit system I might add. I used the without prejudice letter and said that I would settle for £2000.

  • Hi, I am about to send the letter to Abbey asking for my charges to be re-paid.(£2283.00 in total) I have photo copied the info they sent me and am sending them their copies with my letter. Do I need to break the charges down onto a seperate sheet as well or will they accept the pages that they sent to me with highlights over the relevant charges? Hope this makes sense.     i typed all charges,dates and reasons up on excel spreadsheet sent them that with copies of the statements with the charges highlighted

    Hi Jayne,
    I was in the same situation not long ago - yes your right it is just a standard letter. Like i have been advised ignore shabbys letter. If you are waiting for any statements you have asked for that you havent kept they only have 40days - go by your timetable and not theirs!!! If you have all the statements you need and have asked shabby for the amount owed then i think they have 14days to respond otherwise send off the next template and threaten to take it to Court!

    Hope this makes a little sense

    I've been totting up charges from abbey on an entirely inactive account for over a year now and have done nothing. i didn't have the initial £35 and i certainly don't have the few hundred that it is now.. i have moved around lots, lost all account details, then came back to visit parents who had old statements and i realised i'd totally forgotten it existed..

    i just don't know what to do!!

    at one point when i was using the account acouple of years ago twice i was charged £35 for a direct debit of £2 to the nspcc that i didn't have.

    if i ask again it'll be the 3rd time i request statements..

    goodness.. i'm a musician for goodness sake, i'm not made for banks and forms.. once i sort it and get rid of it \(i'm praying i can..) it's pennys in a jar from now on!!!

    any advice would be much apreciated... can i request the charges be withdrawn on the grounds i haven't been near or by an abbey for well over 14 months or so...

    As for capital One yes just send the letter requesting the full charges back if you have all the statements. Still waiting for full list of charges on my dead Capital One card to be received so no, havent actually done this yet.

    Advice I give is based on thorough investigation and the experiences of people on this site as well as my own. We're all helping each other here. :)
