Last week I sent my £10 fee and a request for all bank charges or Statements for the last 6 years. I received 1 years statements soon afterwards. Today I have received a letter basically explaining that they don't keep information for charges applied to my account for the last 6 years but they can supply a list of transactions on my account which will include any charges applied (Statements I assume).
However, to process my request, they are asking for a £10 fee and can not deal with my request until the fee has been received. Obviously I have paid the £10 fee but do I contact them to tell them this or do I wait until the 40days are over?
If they mean they want another £10 advise them that under the DPA you are entitled to the information and that if they cannot provide them except as statements then that is their responsibility and cost to bear, not yours0 -

40 straight days0 -
I have entered the court stage with the abbey national. Today I have received an "acknowledgment of service" and that the abbey has 28 days from the date of service of the claim form to file a defence. They ticked the following box "I intend to defend all of this claim" - has anyone received this? Im a bit worried and not sure whats happening and whether this has happened with anyone else?0

It has happened but please dont sleep over this tonight. Abbey like to push to the end but never go to court and settle at the 11th hour. Also just because they have indicated they will defend it does actually mean they will
Hold your nerve and any questions about the procedure as and when it happens comes back to the boards for advice.
Good luck0 -

I got this a week ago. I think this is just standard practice from the Abbey and we may get a payout before they file a defence (fingers crossed). If not we will get an AQ to complete if they intend to defend - this is my understanding anyway so if I'm wrong, please let me know!!0 -
Just a thought but did you get that in writing ? Defamation, libel and slander spring to mind. Bank workers should be more careful tut tut !
Lol!! I should have asked the guy I spoke with to put it in writing shouldn't I!! Shame on me! I was just totally gobsmacked at what he was saying to "protect" the Abbey. Maybe the telephone call was recorded and I could use that in my court case should it go to court - now there's an idea!!0 -

What do I do next?
Then you make complaint to the Information Commissioner about the delay. The ICO are receiving thousands of complaints related to reclaiming bank charges and this is a popular one. It is also something they may face prosecution for according to media reports.
Write and advise the bank you are doing so, you may find your details magically appear0 -
There doesnt appear to be many success stories with Abbey... Is it likely to go to court? Following my acknowledgment, do they now have 28 days to come up with a defence? Does it usually go that far?0
