    i filed my claim with mcol on 16 march,am i right in thinking they have 14 days to respond to it and they then get another 28 days then?


    Yes you are correct.
    They will usually respond on the 13th day and sometimes the 14th, and the 15th day and will be allowed in almost all of the posts i've read and then have another 28 days.
    Their way of spinning it out, Don't know why they bother cause they have to pay up in the end and all the court costs keeps stacking up.

    Thanks Brickie103. Have sent a letter today with the others and a copy of the letter to abbey to the court to let them know that I will accept the money as partial payment. When I phoned the bank this morning I was told that I couldn't pay it back!!! Can you believe them they will try anything. I has to make you laugh though - if we were in their shoes we would do the same!!! Rest assured I have got proof of delivery with signatures from the bank employees signing for them!!:rotfl:

    Abbey have put in a defence today to my claim for £2820 +£120 costs and have been told by mcol that my case will be dealt with by the small claims court now and I will have to pay and fill in a questionnaire, Should i be worried and how much will I have to pay now for this questionnnaire and will I get anything back! HELP!

    The further court costs is £100 but you can add this to your claim against the bank along with the £120 you paid initially.

    I have read the thread and very helpful thanks but whilst reading I noticed that I have claimed for interest charges that I shouldn't have, should I put this in the questionnaire when I receive it and will this affect my claim?

  • Has anyone had any joy claiming bank charges back from the Abbey? My wife & I have sent the first 2 letters to them in order to claim back just over £3.5K in charges + interest (if it goes to court). We had a reply back stating " They were sorry that we have been so unhappy that we felt we must complain!"

    In the letter it states that they will investigate our complaint & get back to us within 4 weeks. That would take us to April 5th. As they responded within the 14 days we gave them. Should we honour their 4 weeks or is this just a delaying tactic? Are we better off continuing with the next step & send them the letter claiming the full amount back via the courts?

    If somebody could advise on the best plan of action, I would be extremely grateful.

    This is a standard letter from the bank, send off your next letter saying you will take them to court and give them a further 14 days to reply to you.
  • My first post on here, just looking for a little advice.
    As last year was the first year I had bank charges made against me (due to a botched account swap by Nationwide!), I still had the statments with all the charges, I have skipped the asking for my 6 years worth of statments & sent a letter straight out asking for them to repay me.
    I have now recived the standard letter from the Scabby saying "high quality customer service is of great importance to us at Abbey" Blah blah blah "we'll write to you in the next four weeks to let you know whats happening".

    As I see it I have 3 options-
    1. send a letter back threatening court (if i do this do I enter "small claims court" where the template says [INSERT NAME OF COURT] .
    2. wait the 4 weeks.
    3. start court action.

    Advice please.

  • Like yourself, I'm not sure if you put your nearest court that deals with small claims - in my case this would be Manchester County Court, or Small Claims Court.

    Could somebody advise.
