    You must send the letter threatening court action before you actually start your claim through the court. Either leave the court name bit out of the letter or put in your local court. There is a link to find your local court in the Reclaim Help Thread, link in my signature.
  • Has anyone had any joy claiming bank charges back from the Abbey? My wife & I have sent the first 2 letters to them in order to claim back just over £3.5K in charges + interest (if it goes to court). We had a reply back stating " They were sorry that we have been so unhappy that we felt we must complain!"

    In the letter it states that they will investigate our complaint & get back to us within 4 weeks. That would take us to April 5th. As they responded within the 14 days we gave them. Should we honour their 4 weeks or is this just a delaying tactic? Are we better off continuing with the next step & send them the letter claiming the full amount back via the courts?

    If somebody could advise on the best plan of action, I would be extremely grateful.

    The four weeks is a standard letter, we got that one and I immediatly sent the letter threatening court action.We are claiming £2330 seven days after sending that letter they sent us a letter offering £1005 of which they had paid £695 into the account.I dont know whats happened to the other £400.Proceed with your timescale dont give them any leeway.I will be chasing the rest of my money.

    quote the name of your local county court.That is where your complaint will be filed.

    Hi everyone. :D

    I'm taking them to court and I am at the stage where the Abbey have acknowledged the claim and have 28 days to either file a defence or pay up.

    I've just received a letter from the Abbey this morning asking me to send details of how I have calculated my claim, the amount of each charge claimed and details of how interest has been by reference to each charge. I filled in a spread sheet on CAG (think it was the simple charges calculation sheet) which I completed and sent to the Court. It gives a list of each charge, the date the charge was placed on my account and interest at 8% APR - will this be sufficient to send to the Abbey?

    They have also requested my telephone number (which they should have as I still have my account open with them although I don't use it!) and also my email address - am I oblidged to give them this information and why do they need it? :confused:

    It looks as if you are at the stage behind me! I just resent my previous letter together with account details/amounts charged and interest charged. I alos sent them my contact number and email address , and so far have heard absolutely nothing. I have been checking my account to see if I have any entries but again nothing. I remember reading here that you dont have to give your contact details if you dont want to , but I just figured it would be interesting to hear what ploy they would use on me! Good luck

    Thanks Lady E. I've put together a letter giving htme my contact details - like you I'm kind of interested in what they may have to say to me!!

    Its a very frustrating waiting game isn't it. The annoying thing for me is that my other half has an account with the Halifax and he claimed all his charges back by only sending them one letter!! When I challenged the Abbey with this I was told "each case is different and if someone has told you they have got all their charges back they are lying as no banks or bulding societies pay back all the charges". So my boyfriend is lying then - I did all the work for him and read the letter the Halifax sent!! Just shows you the kind of incompetant people we are having to deal with!! :mad:

  • I am currently in the process of claiming a refund on charges from Abbey when they paid a Direct Debit agsainst uncleared funds!

    Abbey acknowledge claim and 'Intend to defend all of claim'

    The claim was filed in the Northampton Count Court. Are Abbey likely to actually contest this claim? If so do I actually have to go to court? If they back down at what stage are they likely do so? I don't want to go to Northampton if I don't have to as I live in Plymouth. But I will because Abbey have really annoyed me now. And what do I expect if I do stand face-to-face with Mr Abbey?

    This is so different from my experience with the Co-op. I closed my account last June. Send a request for a list of all charges over the previous 6 years at the end of December with the obligatory £10 fee. Went on holiday at the beginning of January. On my return I had a cheque for £1160 waiting for me and they didn’t even cash the £10 fee!

    I have an Abbey Acc and an Abbey Credit Card. I've sent both letters and a break down of the charges I want back. My Abbey Acc have responded with a letter which advises me that it will be looking into my complaint and that they will respond within 4 weeks, blah blah blah!! This I'm assuming is a stalling tact tick, and will be sending my 'pay up or court letter' very soon.

    I called my Abbey credit card today after watching that Whistle blower thing on TV last night to cancel an extra payment cover thing I have on my card and that I have never needed! I mentioned the Whistle blower thing and that I didn't want to give Abbey any more money than I need to. They weren't to happy about it, but will cancel it anyway, so that is saving me £8 a month. I also enquired about how my claim is coming along, after looking into my account they advised me that they have not received any letter asking for my charges back!! I was shocked, but It didn't bother me as I sent the letter Recorded Delivery and Abbey signed for it on he 13th!!! WOO HOO!! Their prob NOT mine!! So If I still haven't heard anything from them by Monday, The pay up or court letter will be sent!!

    Keep up the good work people and lets get the Shabbey!!!

    p.s. Please send your letters recorded delivery, it cost's 68p, and it s well worth the piece of mind!
  • Ok! I know this is a silly question so I'm prepared to get a silly answer.

    Q - When giving the banks 14 days to reply do I include 2 days for weekends or do I only count the 5 working day week??

    Please help!!

    i am also having trouble with abbey.they really are the worst bank along with halifax.they just stall and stall all the time...
