    I was just a bit concerned that they would remove the overdraft facilty and leave me in the S**t! However if they give me enough notice, I should be able to sort something out. Does anyone out there know how much notice they would normally give you?

    Can I still claim my charges if Abbey have already refunded some in the past? I called them a couple of days ago complaining about the charges on this months statement and they refunded half of them. :confused:

    in answer to your question, yes you can!
    Just dont include the charges that they have refunded, but yeah, go back upto 6 years!
    I have had one or two refunded in the past when i have phoned up and complained (not many mind!) but i'm still claiming for the rest!

    you're welcome Forbesy100, i would look around to set up that umbrella account now! just in case.
    In my experience, they usually give about a months or so notice.

    ha ha I think all the banks are being "difficult"!! There doesn't seem to be nay rhyme or reason in how they react to each claims, but personally I'd prepare to go to at least file a claim and complete questionnaire at the very least. In reality any one of us could end up in court. If they pay up before then you've been very lucky!

    Thanks again. I will open an umbrella account asap and begin to transfer all my d/d's accross to it so I'm well prepared if it does happen.

    In your allocation questionnaire you want to put a little bit about how the case is a matter of fact and as such should be heard in small claims...nab me when you get that far and I'll direct you to some help.

    Make sure you send a copy of your list of charges to the court to be served with your claim - Northampton Bulk Processing Address :)

    Havin read some of your previous posts i have decided to go down the n1 form route which i have already filled out using the template from the C.A.G
    site, instead of using the head office address i've gone with the local branch.
    The stage i'am at is the 2nd letter 14 day stage is almost up so will be sending the court action 7day letter soon so might as well get everything ready since abbey will take it to the wire.
    Also am i right in saying even if it won't be heard in the small claims it will go to the fast track which is more or less the same as small claims anyhow?

    Received my Allocation form and wondered if I have to hand write the information bit? Could I print the info out from here and send it on an attached sheet? (It's quite long and I'm not sure it will fit in the box with my handwriting.)
    Also received an offer for half the claimed amount from ShAbbey. Do I have to reply declining this or can I just ignore them? (I suppose I could politely decline..........:rolleyes: )

  • Hi All - i'm a very new newbie and suffered at the hands of the Shabbey. I've still got the details but no statements having closed the account after a mere 6 months. Can i still claim back for all the charges they slapped on my account? About £1200 or so to get back....any advice would be greatly appreciated.

    after doing extensive reading on here myself over the last few months, i believe you can reclaim bank charges from closed accounts, does anyone else agree??
    I am not using my account with shabbey and havent done for years but it is still technically open as i have an outstanding overdraft (one i wouldnt have if they hadnt have charged me a ridiculous amount of charges!!)

    i filed my claim with mcol on 16 march,am i right in thinking they have 14 days to respond to it and they then get another 28 days then?
