I'm currently in the process of claiming £1480 from abbey. Have just recieved court allocation questionnaire as Abbey are defending the claim, this needs to be returned by 3rd April.
The same morning recieved a letter from abbey stating they would be defending however would like to offer me GOGW for 50% of claim, no mention of refund of court costs.
Freaked out by court so was considering taking the offer however then noticed that on their defence papers a completely different account number from ours is stated and also they've spelt my husbands first name incorrectly.
Should I go for the full claim or settle. How would this incorrect information stand up in court? also should I make Abbey aware of their mistake and try use it as a bargaining tool or should I just notify the court when I return the questionnaire.0 -
As you can see from previous posts Abbey will take it to the wire. As you have already filed online you need to carry it through and certainly don't accept any offer now unless it includes the interest and court costs that you have paid.
Fill out the AQ, guide in the Reclaim Help Thread which is linked in my signature and reply to Abbey that you won't be accepting their offer and are proceeding with your court claim.
It could be the letter received was a mistake as it has the wrong account number on and you should point this out when you reply to Abbey.0 -

Recieved a letter from Abbey today:
thank you for your letter requesting transaction information under the DPA.
as some of the information you require is currently available it will be forwarded to you within the 40 days time period free of charge in the form of duplicate statements.
Duplicate statements will not detail any of the pending charges that may have appeared on the original in the information on "intrest and charges" section. This is because any charges pending at the time of statement issue will show on the next statement as either having been applied to the account or reversed. Upon production of a duplicate charges will therefore no longer be pending and will show in the list of transactions for the following month.
Information prior to this has been archived onto mircrofiche. I have recieved your administration fee and have requested for this info, which will be sent separately.
Is this letter standard? Just wondering if anybody else has recieved a letter like this?0 -
I have decided to bite the bullet and take Abbey to court as they have just fobbed me off with a pathetic offer of £100! I have completed my forms using Moneyclaim online. The court papers were served to the Abbey at the begining of the month and they had until 25th March to reply. I have now received a letter from Moneyclaim telling me that Abbey have acknowledged the claim and they have now got another 28 days - does ths mean that they are defending? Will I be receiving any forms to complete? Can anyone advise me of what the next step is?

It literally means they have 28 days to file a defence...not necessarily that they will. If they defend you will receive an Allocation Questionnaire to complete and there is help on this forum to do this. You will pay a fee for the AQ and receive a court date. If they dont defend in the time allocated then you win by default.

I copied and pasted all Abbey cases from the success thread to refer to as they are one I will be reclaiming from. There are cases where they defended but in all cases they paid up so dont worry too much0 -
You claiming against Abbey then Twinkly ? They are sods and will take the claim up to the hearing date more or less...they are who I claimed my 6k back from so if you need any help dealing with them once you get past the standard letters and stuff let me knowLegalBeagles0

Oh I already have you on my hitlist as to who to ask questions of if and when I get horribly confused
Just at the waiting for details stage so far. Royalmail shows the signed for letter I sent was delivered so twiddling thumbs for now waiting. Abbey seems variable so we'll see how that goes. Thanks for the offer, as always your advice is very much appreciated0 -

I think the duplicate statement response about charges not showing is in response to complaints of 'missing' charges. People were receiving statements that looked different to usual as they had no 'pending charges' section on the bottom.
This clarifies that charges will not show in this manner as pending on copies but are actually shown on the back of the next months statement in the list of transactions.
The microfiche issue is pretty standard. Information pre-2004 is stored by some banks in this manner and is unreadable in that form. It just takes time to put into a readable format for you but you will get it.
