Hi guys and girls. I'm also in the process of getting my money back, started the ball rolling mid-jan; photocopied detailed statements with 1st letter. they owe me £1795.registered post for next day. Jan 30th rec. letter saying full investigation carried out goodwill gesture £223. Telephoned and said will take you to court unless you can better the offer and why the goodwill if i'm not entitled? Sent them letter saying thanks for £223 but now going to court to get the rest. Which I did 27th Feb. They have said "We will defend". Today they offered me half the money in a letter. Needless to say, I am not accepting the offer. Everytime I read your posts I get deja-vu. Abbey like to string it out. I will wait and see what happens next, do not know when I'm at court or how long they get before they pay up.Please,does anyone know the time frame for all this? many thanks.:p0

Bon, unless Abbey have changed their strategy in the last few days you may be in for a long slog. My first letter was sent back in Oct 06. I've sent several since.
Started money claim online in Dec and they filed their defence in Jan. Moneyclaim transferred the claim to my local court. When Abbey filed their defence they offered exactly half in full and final settlement which I declined. Sent the Allocation Questionnaire back at the end of Jan then heard nothing until last week when the Court sent their directions but no date set as yet for the hearing.
I've just started setting out my witness statement and skeleton argument. I would suggest you pop over to Consumer Action Group, if you haven't already, for information and suggestions for your court bundle and other documents which you may need for Court as Abbey are stretching things out to the very last minute just to inconvenience us.debt free...yippee :dance:

Im about to start Claiming back about £1700 back in charges from abbey before they changed name. (account is closed now) im jus wonderin do i send my initial letter to the branch i had the account at or their HQ complaints Dept.?

I sent the template letter from CAG website to the Abbey on the 6th March giving them 14 days to reply to my claim of £3330 in illegal bank charges. Received a letter today explaining that one of the Business Managers team will be investigating and that this will likely take 4 weeks. I have not seen this mentioned on any of the posts in the Abbey section (although I haven't read all 40+ pages to be fair), so I'm wondering if this is normal or just another tactic that they are employing to worm their way out of repayment.0

Is it a business account ?
You should still send your second letter after the 14 days given in the first letter. Don't forget you need to amend it partially to remove the consumer references, if it is a business account.LegalBeagles0 -

I intend to write back with the threatening court action letter but also saying that if they pay me £900 + the £70 within 14 days I will accept this settlement. Do you think this is the right thing to do??0

It is certainly a valid option and the logical step to preceeding court action. Make sure any settlement is put in writing by them and read thoroughly for their conditions , as well as putting any acceptance yourself in writing with any conditions of your own. Money has appeared but the battle isnt over and there are things you need in writing. Good luck0 -

Hi all,
Received a letter from Abbey today saying the usual rubbish that they sorry i felt the need to complain blah blah and that they are offering a "goodwill gesture" of £120 (my claim is for £2579, last letter i sent i offered to accept £1900. I thought that because my balance on my account was at nil that they had already made a partial payment, as it turns out, the overdraft of £436 that i owe is with a debt Recovery firm and thats were they're now sending the £120)
My question is, i'm now at the stage where i need to file a case with MOL and am i bit nervous about the forms i need to fill in and also having the right information to state my case in court.
I think the debt of my overdraft is now with the recovery firm and thats why my balance is showing at nil.
Can anyone put my mind at rest about filing the claim and what documents i need? I have copies of every letter i have sent ready, but is there any thing else i should do?
its crunch time!! but i aint giving up!!!
