  • I have been a customer of Abbey since I was about 12 and now have a joint account with them.
    I have a large o/d of about £4k which is still active and after doing my unlawful bank charges calculation I am owed £4300 without statutory interest.

    I know there is a limit for small claims court of £5k but MSE says this limit is before statutory interest.
    Therefore should I include the interest in my first letter to Abbey or just leave it off to ensure I get an easier settlement.

    I am new to this so any other advice greatfully received.

    Martin says to use interest as a bargaining tool, but remember, you are not entitled to any until you file the court claim. Therefore if they offer you the full amount before the claim, you cannot hold out for interest.

    Hi everyone,just applied for charges at abbey,recived a letter saying they will write to me in four weeks time to let me know what is happening! I can't wait!Literally!By then of course the oft will have decided on the matter.

    Stick to your timetable and don't concern yourself about the OFT. It's unlikely to make any difference to claims.

    Hi Kat1234, i am claiming back £2700 with Abbey too and have an overdraft of £436. I have just sent the last letter off before i claim with MOL (Moneyclaim online) Just before i did though they paid off my overdraft of £436, which i assumed was their attempt at a "gesture of goodwill" even though i havent heard from them since! My balance is now at £0, however, they're not getting away with paying the rest back!
    So in answer to your question, no, it doesnt matter if you are overdrawn, just go for it, you have plenty of support and advice on here, and being overdrawn wont matter, just think anyway, if they hadnt have charged you so much, you wouldnt be overdrawn!!

    Hiya alonso, if it helps it took about 5-7 working days for mine to show up, they do have upto 40 days though, sit tight, they will come, there'll be a big wad so you wont miss it in your post!

    If it's any help I sent my letter exactly same date as you 22/02 and I received statements for the last 12 months early last week(roughly 6th March) I rang yesterday to ask about the remainder of the statements and they said they have a back log and will send it out to you. They banked my cheque on the 9th March and according to the advisor at Abbey that means they have started to download the statements from the microfiche. As some one says earlier ,stick to your timescale of 40 days and the statements will come before then.

  • Have asked Abbey for my charges back two weeks ago, they have replied by saying they will investigate my complaint, and will take about eight weeks!!!Any ideas as to what i should do now??? Do i go ahead and threaten them with the small claims court or what!! I'm stuck:confused:
