    Hi Brickie103, when I filed at court against Abbey I forgot to include photocopies of all letters sent/received and photocopies of statements. Abbey sent snotty letter saying entitled to see evidence to be presented. So sent all to Abbey legal dept. then filed same documents/letters with the courts. Today I received an "Allocation questionnaire" from the court with a letter saying the defendant has filed a defence. Have now got to fill in questionnaire and pay £100 to the courts, I already paid £120 to take them to court! I presume this money is added to the "court costs" and payed back to me if I win??? Can anyone help? Many thanks

    when you file at court you pay a fee depending on amount claimed then when the bank defends a claim an allocation questionaire is sent out which you then complete and the cost is a further £100, so all court costs is then added to your claim when you win your case.

    I had exactly that from Abbey, the stuff they sent from Microfiche was fine, but the 14 months of duplicate statements had the charges removed, it was only because i happened to find an original statement at the back of a drawer that i realised the charges were missing. I complained to the call centre, the guy said it was definately not something they would do and sent me the exact same statements again!
    After booking an appointment to see the manager of my local branch (by telling her i wanted to talk about a mortgage!!) I brought it up with her. Thankfully she was very helpful and gave me a copy of the computer printouts which detailed the ammounts charged.
    Keep your eyes open!!!!!




    Doesnt this constitute to false accounting on Abbeys part or failure to keep full and proper records?

    Would be good to see what the Ombudsman makes of this so called - mis-accounting?

  • I sent off the first letter and got 14 months worth of statements back with a letter saying about the rest of the statements being on microfiche. How long should I wait for them to send me the rest of my statements from microfiche??

    Abbey wont settle until the last minute but stick to your guns and your time schedule. They are just trying to see how many people will back down or chicken out before court. Thing is, if you are going to threaten them with court you must be prepared to go to court and therefore do all the research and reading that you can.....you wont actually get to court but you'll need to be prepared. They just want to see how far they can push you. Of course its entirely up to you what amount you choose to settle on but to back down just shows them that they can still intimidate people.
    If you write a letter of settlement and you dont want to be embarrassed by your offer if they show it in court.......just put 'without prejudice' at the top of the letter and they wont be able to disclose it at a hearing. You will notice that all their offer letters say this too. Good luck.

    Hi I wonder if I can ask some advice please I have sent the letter to abbey and my £10 chq asking for the last 6 years statements but they have only sent through the last 14mths or so without anything else no letter nothing?

    What do I need to do now?

    Hi, if after the 40 days i still have no statements and i send a 2nd letter requesting that they have breached my rights under the D.P.A. data protection act do i send the 2nd letter to the Milton Keynes address below:

    Thats sounds fine hugo. Give them a further 7 days or you will report to the ICO and/or take court action to enforce complaince.

    They seem to reply from here, but no money back yet !
