Hi there
I have just had a letter from the abbey offering me a substantially less amount than I am claiming for. The other point they make is that they will put the money in my account in 10 days. However, I have looked into the account this morning and they have added the amount already.
Has anyone else had this happen and what did they do? The case has been filed and I don't want to accept this money. Do I just minus that amount from my claim and carry on? Do I let the courts know?
This bank is a total nightmare to deal with!! Be warned that they may at some point say that they have not received any correspondance from you. This has happened to me and a couple of people that I know.

This happened to me and I just deducted the amount they had offered me from the total claim and I have submitted figure this to the court. Abbey have acknowledged the claim and I they have now got 28 days to either pay up or file a defence.0

Hope i am on the right thread
I sent letter of to abbey national 2 weeks ago requesting the six years of bank statement they sent me covering the last 14 months but also said that any previous transactions have been archived into microfiche and it is not possible to provide you with a computer print out of this information, however they have made arrangements for then to send a list of archived transations between 2001-2005, which we have not yet recieved, but with regards to any 'manual interventions they may be made on our acoount, which they consider to mean an action that is not automatic or computer driven and they are not all recorded so if a member of their staff looks at a paper document realting to an account a record is not always required, or some may relate to work carried out by a departnment rather than individuals where no central record of activity is kept as that is not the kind of information we nedd or that a customer would normally request.
Does anyone know what this mean are they saying that we cannot have this information if so HELP where do we go from her

Can I still claim my charges if Abbey have already refunded some in the past? I called them a couple of days ago complaining about the charges on this months statement and they refunded half of them.0

Thank you for that. They have been a pain so far. They have delayed things kept sending letters asking for another 4 weeks to respond etc. All of this was ignored until the letter this morning! In the last letter they said that no correspondance had been received but were acknowledging a letter!!! I just sent another copy of everything registered again.0 -
Just waiting for a court date now.This bank appears to be the worst to deal with. They offered us half the claim a few weeks ago but no contact with them since.In my allocation form i asked the judge to order standard disclosure so i hope when the Abbey get wind of this they will get out the cheque book and give us OUR money back before this gets to court.When they do pay up i will be straight on line to let you all know as success stories are few and far between where the Abbey are concerned.0

I have filed my claim with MCOL which was acknowledged by the Shabbey on 6/3/07. All I have had from them is a letter asking for details of my claim , my account no and how I calculated my interest.They also wanted my contact details, I sent back a recorded del letter on 15/3/07 with all that info , and so far nothing ....diddly squat. I have checked my account on a daily basis and no extras , should I just wait and see what happens ??0

For all of you other unlucky people who are trying to get their bank charges from Abbey, please, please do not give up !!!
It took me from middle of January, but eventually got my cheque today (full details of my claim on the Success Thread).
You just need to keep chasing them, stick to your timescales, not theirs, and be peristent. You will get your money back !!

I have literally just filed with MOL and its cost me £120 which i cant really afford! So i hope this goes well!
I havent a credit card to whack the court costs on so this is gonna skint me this month and i believe i have another £100 court costs to pay when the AQ comes through!
Can you give me any advice at this stage?
I am a bit nervous, even though i am claiming £2700 approx from abbey plus court costs. I owe £436.60 overdraft from years ago, (i dont use this account anymore) i have received a letter from a debt collection agency this morning over this and i have phoned them and told them of the situation. They are making a note of this in the meantime.
I had a letter from Abbey last week saying they are willing to refund me a meesley £120 which they are forwarding on to Debt recovery, usual stuff, if they dont receive a response within 8 weeks they will consider the matter closed blah blah!
The last letter i sent them, stated that i was willing to accept £436.60 (outstanding balance of my overdraft) as a partial payment but i still intend to claim for the rest of my money. (i wrote this because i checked the balance of my account over the phone and it was at zero, so i thought they had already made a GOGW)
(hope you're following this ok!)
My question is, should i write back and state that i am willing to accept partial payment of £120 but still intend to claim for the rest?
If i dont, will it affect my claim in court?
I started this in mid january same as you, how long did it take from when you filed with MOL to get your money back?
Sorry about the longwinded post but i really need my mind putting at rest as everyone has been great so far!

According to martin, they may tell you to get lost after thisclaim has been made, in my experience i had an overdraft with abbey but that was taken away before i started my claim, but yes they did write to me first saying that that was their intentions. Sorry i cant help further, but i should imagine they would write to you first!0 -

This has happened to many people on here, just write back and say that you are willing to acccpet the offered amount as partial payment but still intend to claim for the amount you have originally asked for. Refer back to the letter templates for the right letter.
Also, dont forget to send all the correspondance by recorded delivery, i have and noted all the tracking numbers, that way they cant deny that they have received your post.
I agree, they ARE a nightmare and it gets you even more annoyed, but be rest assured that we will win in the end, you just have to have the determination!!
