Ok, i am claiming with Abbey too so i'm afraid thats the only one i can comment on althought they are all (the banks) pretty much following the same procedure with this!
I got the same letter, and complaint leaflet. Stick to your time scale, you are in control not them! Do things by your rules! or rather Martin's fantastic advice along with everyone elses! (They wouldnt think twice about bullying you for money that you owed them!) So yes, when the allocated time that you have set, file your claim with MOL (money claim online).
If you are offered lower than what you are asking and you're not willing to accept it, use the letter template stating that you acept that given amount "without prejudice" but still intend to claim for the rest of what you are asking for, then carry on regardless!
All the letter templates are on the bank reclaim thread on the main website, which tells you eaxctly what to put/say in the letters, you may just need to adapt it a bit to suit your suituation.
Carry on though, you'll get there!

Quick question!! I'm trying to claim back some £1500 back for Shabbey, and started that a few weeks ago. I have just noticed that £50 is going to be taken out of my acc on 1st Apr for going over my overdraft and passing a visa payment, could I call Abbey up and demand that they refund me that cost even though i'm trying to claim? Would that be too cheeky?? Would it affect my current claim?

hi just recived a letter form abbey saying thank you for my recent enquiry requesting information on my account and they all acknowledge receipt of my 10 pounds they also say i confirm that arrangement have been made for the information i have requeted to be sent to me. the transaction information remaining on there systems, normally covering the 14 months. will be sent out in the form of individual duplicate statements. i should receive these within 5 to 7 working days of the date of this letter
any previous transaction have been archived onto micofiche and it is not possible to provide you with a computer print out of this information. however, i have made arrangement to send you a list of archived transaction between 2001 and 2005 under separate cover
with regards to any manual intervention that may have been made on my account we consider manual intervention to mean an action that is not automatic or computer - driven. not all manual intervention are recorded, for example if a member of staff looks at a paper document relating to an account, a record is not always required. similarly some interventions may relate to work carried out by a department rather than individuals where no central record of activity is kept because this is not the kind of information we need or more importantly that a customer would usually request

hi, have asked Abbey for my charges back but got the normal reply of " sorry your unhappy....will investigate ...will take four to eight weeks " , so i sent the letter threatening court action..that was thirteen days ago, do i phone and asked what they're going to do or wait till the fourteenth day ..tomorrow and just send the online court form????

Just received Abbey's defence in relation to my claim! What they have written is quite funny really "The claimant's contention that the said fees are unenforceable and/or are "penalty charges" is denied. The fees reflect and are proportionate to the Defendant's administrative expenses incurred due to the Claimants breach of contract and are a genuine pre-estimate of the damage duffered by the Defendant" So it costs the Abbey £32 in admin costs for an unpaid direct debit charge!!!
A quick question - I started trying to claim my charges back in November last year and in Abbey's defence they have written "The Defendant denies that the Claimant is entitled to charges prior to 5 March 2001 by reason of Limitation act". From what I can gather they are going back 6 years from the date of when the court served them with my claim. I requested my statements back in August last year and I think I should be entitled to claim charges going back 6 years from the date I started to write the Abbey to get these charges back - I am right in thinking this or is this another of Abbeys shabby tactics in not paying back what they should.:rolleyes:
I just hope that they will settle before it goes to court as I am starting to get a bit scared now! I'm only claiming £525 plus interest which makes it just over £800.0 -
IRATE!!! Doesn't quite cover it.. the little gems have STILL (after 7 weeks) not sent the statements through.. they have bounced every cheque I have written in the last 6 weeks and have now.. cancelled my debit card!!!!!!
Good job I have everything transferred over to be paid into another account.. apart from hubby wages which are due in tomorrow!!!!!

i got my letter back from abbey yesterday with the usual stuff "we;re sorry you felt the need to complain, hers a copy of our complaints procedure and we will investigate your complaint" etc lol well who cares what they say ill be sendin my second letter to them on tues 3rd april regardless of how long they want to investigate for.0
