    You could also "advise" them that "The Information Commissioner has deemed microfiche to be a relevant filing system under the Data Protection Act. As such microfiche must be represented in a fully legible and comprehensible form on paper in accordance with my entitlement to this data."

    Can anyone give me some info?

    I sent my first letter using the money saving template on the 23/02/2007, I sent it by recorded delivery with a £10 PO crossed and made payable to abbey,
    this was sent to Abbey, PO Box 382, Prescot Street, London E1 8RP today I recieved a letter from them thanking for a request for copy statements if I want these I must pay a £10 fee and fill out a AUTHORISATION REQUEST FOR ACCOUNT TRANSACTION STAEMENT form which has been enclosed and send back to Abbey, PO Box 297, Bradford, BD1 1BR.
    Does this mean I sent the first letter to the wrong address, it's on the front of my statements and is a customer service address so I thought any complaints start at this address.
    Any help please.:mad:

    I sent the first letter along with the cheque recorded delivery on 27th Feb and recieved a reply today saying they will forward only 14 months statements shortly and a seperate list of transactions between 2001-2005 will be sent under seperate cover.
    What this means i dont know-just have to wait and see what i recieve.

    Noticed that Miscellaneous fee refunds totalling £590 ( claim is for £4k plus) deposited into my bank account no communication from Abbey. Called them and said they had sent me a letter asked them to send it again which they did this am. Usual stuff gesture of goodwill howver chap on the phone said I could take it to stage two. Any advice out there on what to say in the letter? do I accept the £590? Given the looming deadline of April and the OFT announcement and the fact I live in Scotland I am tempted to tell them what I will accept starting to waiver now please help. Thanks

    I sent my request to my local branch, they then forwarded it nto whoever needed it as I got a confirmation letter advising me my staement will be with me shortly. I've now received all my statements from Abbey, it took 3 batches to get them all.

    I have now worked out all my charges and am asking for £1525.00 back in total as i'm claming intrest aswell.

    I have sent all letters recorded delivery, as it only costs 68p to do this and that way they can never say that they didnt receive them.

    The seperate list of transactions are held on a different database as they are the transactions that are the oldest, when you receive these, they look scary and a nightmare to look through, but it's not too bad. Abbey usually takes charges on the 28th of each month and the code for charges is CHG, so that's all you need to look for, highlight them as you will probably need to look at them again as you enter them into Martin's calculator.

    Abbey sent me so many paper statements but the rest are to follow as they have been microfiche'd.

    Thing is, I already had the last year and a bit statements so the paper ones sent weren't really needed, but the most strangest thing was on the duplicates, they show NO charges but I know from my originals, that there were charges.

  • I can't see the harm in writing back to them stating that you accept the refunds as a 'partial settlement' of your claim and that you intend to pursue the balance of your claim. Not sure about the difference in law for Scottish claims suggest you check out this site before you do anything:

    Write back and say you accept the £590 in partial payment and without prejudice but will be continuing to court for the rest and give them 7 days to come back to you. If you have an amount in mind that you would accept you could put that in the letter or indeed phone them. Have a read of this thread regarding claiming in Scotland.
