Hi There , I have just had a reponse to my first letter to Abbey National.They have said that they can only send me the last fourteen months of transactions.They are unable to send me information from 2001 - 2005 because this has been archived onto microfiche and is not available on their computer system.I know there are many charges on my account and I do not have this information myself.Is this a ploy ? Surely they must have some way of supplying this information.Any advice or help wuld be great. Many Thanks Ro.0

The Other Half was sent print-outs from microfiche records for his Abbey mortgage payment history "free of charge because they are not very customer-friendly" in the way they display information. So it's definitely possible to provide the info that way, tell them they have to provide them under the Data Protection Act so either they send you the microfiche printouts with an explanation on how to read them or they have to sit down themselves and trawl through it, sending you a list of charges. Threaten them with the Information Commissioner if they don't comply.Reclaimed thanks to this site:

Just going through the batch of statements I've received (last 12 months for now) I've noticed Abbey are pulling a fast one. First page only highlights the account summary and they have deleted the charges that will appear soon on the account. I've checked my last 2 months statements that i had against the duplicates they have sent and the charges are missed off the front page. Is this fair as it's not really a duplicate of the statements I've requested. I can still get the charges but i have to look at the itemised list on next page.
Just a few quick questions before I start counting the charges.
1. Can you reclaim for returned cheques £35.00
2. Charge for overdraft that has not been authorised £20.00
3. Interest charged while account overdrawn £9.18 (this will of cos vary)
4. Charge for clearing VISA payment whilst overdrawn £35.00
5. Unpaid direct debits £35.00
Sorry for asking obvious questions but want to make sure i get it right first time. thanks for any help0 -

I received a similar letter if not the same one and they sent me the first 14 months in a few weeks and then the rest of them turned up about a week later in the form of microfiche. Just hang on for them (obviously providing they turn up within the 40 days allocated!) they will be full statements and then as you scan through them for your charges look out for the transactions abbreviated as CHG and the date if you are calculating interest.
I'm at the stage now where i am about to file on line with MOL. As i havent heard back from them after me sending the "7 days to pay up or face court" letrer.
Persevere!! It'll be worth it in the end, and they is an abundance of help on here for you, just takes a little searching!

I also pointed out to them that i should be charging them for my increased phonebill as i am continually on hold on a landline,( non local and non freephone number!) to them for ages every time i phone up, so maybe i should charge them for MY phone bill! They said that they have every right to charge that amount as its in the terms and conditions blah blah blah!
This will mean that i as i try and pay off this debt and get upto date they are going to make me more in debt as time goes on!! Cant win!
My question is, can i use the same reclaim procedure to claim back the £40 charges with them? Or is there anyone who can help me stop them from doing this? Surely they would be working under the same guidelines as banks?

Hi, I'm claiming back roughly £150 in charges from Abbey National. I posted off my 'form' letter to reclaim the illegal charges at the end of January, and received a standard 'we are dealing with your complaint' letter from them dated February 6th.
This means that they have now not written to me within the promised four weeks (according to their letter) to let me know how my 'complaint' is progressing. I feel a bit let down by this.
Is it possible that they are stalling for as long as possible whilst they wait for the OFT ruling? If I referred my complaint to the small claims court now would my case be heard before the OFT ruling is announced anyway? (I live in Edinburgh). From what I've read elsewhere in the media, the consensus is that the banks will be more likely to start contesting cases once the OFT ruling has been made.

I know what you mean by being scared by the prospect of going to court but, as others have said, we must stick to this. This money is ours not theres.
And, after all, what is the worst that can happen? You lose, which means you are no worse off then you are now.
Better to have loved and lost................
Stick with it Harry. It is well known that all the banks use scare tactics and pressure. What they are trying to do is scare people away from claiming what is rightfully theres. The sad thing is that it sometimes works.
We have a wonderful community here full of knowledgeable people to help and support us all the way.
Don't back down now.

They aren't stalling just busy with all the claims and firing out standard letters.
