    i sent the letter threatening court action on a saturday,i have gave them 9 days to reply including the saturday and sunday still no reply,should i fill in the mcol form online now or give them more time?
    also my claim is for £7438 plus interest,would it be easier if i just requested £5000 plus interest and go through the small claims court?
    any advice appreciated

    Hiya peeps!

    I wonder if any of you can help me with something else as everyone has been great so far and i've been lurking for weeks to see what other experiences people have had with this.

    I have my mortgage and a loan with GE Money, the mortgage isnt the problem but i am in arrears with the loan because i was on long term sick for a few months and couldnt afford to pay it. It works out that i am about 2 months behind result in arrears of only about £250 quid (ish)
    The thing is i have just paid off £50 of this and am still keeping up to date with regular payments. But after a harrassing conversation with them today, they are continuing to whack on top £40 "administration fee" a month because i cant afford to pay the arrears in one go. It seems the £50 wasnt good enough for them, even though after an argument they accepted, i told them it was £50 or nothing (how dare they!!?)
    I complained that the charge of £40 was too high for the sake of them making one phone call to me to chase payment and sending out an automated letter. I also pointed out to them that i should be charging them for my increased phonebill as i am continually on hold on a landline,( non local and non freephone number!) to them for ages every time i phone up, so maybe i should charge them for MY phone bill! They said that they have every right to charge that amount as its in the terms and conditions blah blah blah!
    This will mean that i as i try and pay off this debt and get upto date they are going to make me more in debt as time goes on!! Cant win!
    My question is, can i use the same reclaim procedure to claim back the £40 charges with them? Or is there anyone who can help me stop them from doing this? Surely they would be working under the same guidelines as banks?

    Can anyone help me?? please??

    I'd just like to add that i am currently in the process of claiming back from Abbey (or should i christen them "Shabbey" like evryone else?!)
    i am currently waiting for a reply to my 7 day letter before i file with MOL, they have until tomorrow to reply, then thats it, i go to war!!

    Hi all,
    I have just handed my Forms into the court! this is so exciting, i feel like a school kid all over again! actually i think i am reliving my youth!
    I have sent all the letters, given them time, even phoned them today, and they tell me:
    A: that my case has not even been allocated to anyone,
    B: there is no one that can discuss my case with me,
    C: and also they are not interested in avoiding court action!

    What a bizarre organisation! you would think that they would be interested in avoiding judgments being made against them, and that they would have employed staff to deal with the influx of complaints at this time!

    well it is time to rock and roll, i have no quarms in attending the small claims court, it is all good experience for me( i am a Law student).
    I will not accept anything less than the amount including the interest, now that i have filed with the court, and i will be adding interest on a daily basis, so that means that when they phone up and offer me, or their solicitors offer the full £3688.19, i can not possibly accept, because each day i wait the inerest is added! and that amount was up to today!

    come and get me Shabbey!!!!

    Hi everyone,

    I have handed in my letter to the Abbey in person on Monday and I also obtained a receipt from the member of staff who took off me.
    My question is this,
    From the day of handing in your letter giving them 14 days to come back with what is owed to you and giving them a breakdown of the statements of the total amount of charges they illeagally took from you and including interest on the amount due. How long does it take from the start of this process to get your payout? Is it days or weeks or months or years?

    The reason I am asking this is because if the bank have illegally taken the money in the first place as reported on the front page of the news of the world on 04/03/2007 I feel the banks cannot and should not argue or offer any less than the ammount they have illegally taken and at times leaving people destitute and worried and being robbed from one month to the next trying to catch up and get back into the black over the years.

    So therefore when the banks have received the 1st lettter giving then the outline of the claim and complete breakdown of the claim they should check the records and find they owe this and pay up and stop stalling their cutomers after all it was not theirs to take in the first place and part of the blame should also lie with our government too after all they knew of this and allowed this drag on over the years causing a whole load of misery and undue distress. I believe all of this could and should have been stopped years ago.

    One more thing I feel I have to say, many may agree or not agree.

    If our banks have been ripping us off for years and over the years we are being ripped off left right and centre with extortionate taxes in one form or another - If we dont have faith in our banks or government or the very people who tell us right from wrong - god help the future human race because in years to come we wont be people but robots paying for all the GREED from the very people today trying to out do one another just to get rich off the backs of the POOR and already hard pressed. :beer:

    Sounds like you have the determination i have, i'm going to be filing a MOL tonight as i havent heard anything yet after sending my 7 day letter.
    bit nervous because i need to make sure i've done all my homework! But i'm ready to go to war!

    Does anyone have any advice regarding my claim:

    I have recieved a letter this morning from Abbey, stating that they offer us £1610 refund against a £3200 claim. They have submitted a defence to the court, and with the imminent OFT ruling I am wondering whether it would be better to accept the offer at this time.

    If it would be beneficial to see the claim through, should I contact the bank advising them of my decision?

    Also, does anyone know how long the process would now be to get a court date, from the bank putting a defence in?

    Any advice would be greatly appreciated.

    Have just started to try and claim my charges back form Abbey, sent them a letter 3 weeks ago requesting a listof charges over the last 6years. Recieved something from them this morning,and insted of a list of charges theyve only sent account summarys for the last 6months this doesnt list charges at all.
    So where do i go from here??

  • I recently asked Abbey to repay my bank charges using the templates on this website. I have just checked my account online and it seems that Abbey have refunded £210 of my £425 claim. I have phoned them and they said they sent me a letter on 1st March [which I haven't had] offering me a part refund. They have obviously done so without me agreeing and I now have to decide whether to agree to this or take it to the next level and reclaim the full amount.
    I just want some advise really. I'm not sure of the success rates of refusing the first offer. Also do I run the risk off losing the whole amount if I refuse?

    I am new to this, hope someone can help :confused:
  • I do apologise if I am asking a silly question I've not done this before and having 2 young children I've only quickly scanned the other threads.

    Anyway, I have recently been trying to reclaim my Bank Chrges from Abbey. I sent them the second letter asking for my charges back and received a letter about 10 days ago saying they were dealing with my complaint.
    I have just checked my account online and they have refunded £210 of my £425 claim without notifying me. I've just been on the phone to them and they apparently sent me an offer through the post last week. I never received this but now have to decide whether I want to accept this offer or try for the full amount.

    Not sure what the sucess rate is of refusing the first offer :confused:
    Is it possible I could lose any refund if I refuse the offer?
