Hi,
Im just at the point of beginning the court process.
My original dealings with the Abbey was in early January and the earliest charges I am claiming for was from 31/01/01. This was in the six years limit when I started the process but now obviously they are beyond the six years.
Can I still claim for this because it was in the time limit when I originally asked for the money back or do I deduct these charges from my claim?
Any help would be great, Im due to put the papers in court this week so need help quickly!

The 6 years should start from when it is deemed your bank received your first letter so they will be okay.0

It might seem un-necessary but just send the bank the list again and make sure you tell them you have already provided all the information they need.0 -

Thanks for that, I was a bit worried as there were a few charges from the end of Jan that I thought I may miss out on.0 -

Yes, Abbey have just sent me the same letter.
I found this reply from Martin on what to do: Martin says:
I would send them an e-mail/letter (keep a copy whichever) which simply lays out
A. The fact you have already detailed the charges - including the date of the letter you sent with the charges in and that you are concerned they are dealing with this case without having kept the paperwork.
but
B. To confirm them I enclose them here.
Then detail the charges
There is nothing to lose by resending the same information as you have previously sent.

I know what you mean by being scared by the prospect of going to court but, as others have said, we must stick to this. This money is ours not theres.
And, after all, what is the worst that can happen? You lose, which means you are no worse off then you are now.
Better to have loved and lost................
Stick with it Harry. It is well known that all the banks use scare tactics and pressure. What they are trying to do is scare people away from claiming what is rightfully theres. The sad thing is that it sometimes works.
We have a wonderful community here full of knowledgeable people to help and support us all the way.
Don't back down now.

i had my claim for £455 charges rejected by abbey, they sent back a 2 page letter saying that they didnt accept their charges were unlawful or disproportionate!! how can they not be at £35 a go!!

I have a question which may have already been answered (to much pages:o )
but here goes anyway 'I've been with Abbey since september 2003. I'm not gonna ask for the last six years, will this affect anything?' AND 'is it neccessary to send a letter, i.e. can you phone? Also do you think the lower they owe the more likely they will pay? As i think mine is vastly small compared to others (you guys).0 -
Hi ive posted my letter to abbey with my £10 asking for my statements on the 26th feb. Today i recived a letter say that they acknowledge my £10 they are going to send my 14 months worth of statements within in 5-7 days but it say any previous transactions have been archived onto microfiche and is not possible to provideyou with a computer print out of the information. However,we have made arragements to send you a list of archived transactions between 2001-2005,under separate cover. With regards to any manual interventions that may have been made on the account. We consider manual interventions to mean an action that is not automatic or computer-driven.Not all manual interventions are recorded,for example if a member of staff looks at a paper document relating to a account, a record is not always required. Similary some interventions may relate to work carried out by a deparment rather than individuals where no central record of activity is kept becuase this is not the kind of information we need, or more importantly, that a customer would usually request. Dose that mean that they will still be sending me my list of charges or statments and how long do ii need to wait till i can send the second letter.0

I sent first letter 22 Feb
I've got EXACTLY the same thing back a couple of days ago and today I've received 12 statements going back a year. Haven't looked at them but will do tonight and highlight all the charges.
I'm assuming the rest (5 years) of the statements will arrive in a couple of days.0
