    Right.. HELP!!

    I am 6 weeks into claiming back the bank charges from the Abbey and they have started returning cheque unpaid even with the guarantee card number on them.. is this special because it is me or is it happening to everyone else as well??

    They of course then want to charge me £35 for being over the OD limit (even though I wasn't !!) and £30 for the privelege!!!!

    I have had these charges annulled but it is a hassle!

  • Hi, has anyone had any luck claimin from ABBEY? I have jut received my sucess letter from my bank, ie Halifax . My husband banks with ABBEY and he`s just about to embark on his "claim". I`ve been reading through a few posts but not found anyone with an "Abbey" story.

    Hi, I hope someone can help me. I've gone through the sending of letters and last week got to the court action stage - which I've proceeded with. The Abbey owes me £300 and after they received the court action service, they responded to the very first letter I sent 4 weeks ago saying as a gesture of goodwill they are sending me a cheque for £60. The letter was sent 2nd class which means I now have about 2 days before this cheque arrives. Do I send the cheque back saying 'no I want EVERYTHING I'm owed' or do I keep the cheque and write a letter saying i'll accept it as part payment and will continue with the court proceedings until I receive everything i'm owed?
    I'm just worried that by keeping the cheque it will look as though i've accepted the "goodwill gesture" which I don't want to do.
    Any advice would be gratefully received. :(

    Keep the cheque and right back saying you accept it in partial payment and without prejudice and will be persuing them through the courts for the rest.

    But do wait until the cheque actually arrives :)

    Abbey have paid up in many claims, your husband should be able to get his charges back as well.
  • I have read all these success stories with money being refunded by Banks however, Abbey have refused on 2 accounts to refund any charges and advised that if I wanted to take it further to contact the Ombudsman. I threatened the 7 day letter of Court action however they have advised that they will defend any claim. Any further suggestions anyone???

    Hi All,

    Have just picked up on this thread but have been following the Consumer/Bank action group for some time. I got a letter from Abbey on Friday to say they were paying up on my claim of £1300+ plus interest and court fees - all this before a court date of 16/3/07.

    Claim has been going on for some time as Abbey failed repeatedly to supply past 6 years bank statements despite DPA request, so in Sept 06 I lodged an estimate claim through moneyclaim online, based on charges on bank statement for last year x 6. Abbey imediately lodged a defence but also offered me half of claim. I refused. Court issued an allocation questionnaire which I filled in and returned. Court date set as above. Then just after court date set all 6 years bank statements mysterioulsy appeared through post - not from Solicitor but from customer services. When I trawled thgrough I realised that my claim was overestimated. I agonised over whether to amend court application but decided that if it did get to court I would explain it then on the basis the information was not provided until at a very late stage and not as part of the court process. Happily it did not come to that.

    Abbey have not threatened to close my acocunt but this may come and I am ready for them!!

    i'm in the beginning stages of reclaiming my charges from abbey-sent off letter number 1 around a week ago.
    i am very impatient and on tender hooks whenever i hear the post drop through my letterbox-they must owe me thousands and hoping to recieve all of it back!!
    would love to hear of anyone elses cases regarding abbey-eg the success rate of being paid and how long it may take!!!

    Double check your figures again just to be sure and send a letter advising them your figures were in error and to disregard your previous letter giving the new total. I think this should be ok you havent filed a claim yet and this is simply a letter of correction.
