Maisy_Mouse wrote:Hi Received my letter from MCOL today confirming Abbey are defending. On the same day I received a letter from Abbey today saying they had not had any letters from me detailing the charges and interest.
Of course, they have! As they have written to me in response to my letters. Should I send them again as this letter did come from a different address or are they "at it" again?
Has anyone yet been to court with Abbey or have they always withdrawn at the eleventh hour?
Getting a little nervous I may actually have to go to court!
Thanks

We Have Statements From Abbey Going Back Six Years As We Requested From Them But They Are Not In The Usual Format.they Give No Description As To What The Charges Are For (particularly The Older Ones) When We Reply To Their Request As To What We Are Claiming For And Why And How Did We Arrive At These Figures What Do We Write As We Are Given So Little Information From These Old Statements0

This can be a problem as your initial request asks for lists or statements but you can go back to them and say you don't understand the list and can we now have copy statements to back it up.
I would suggest you do this but start your claim now by using the lists you have and then you can do a better spreadsheet of your charges when you get the statements at a later date. Do watch that you don't include interest in this initial claim letter.0 -
After checking last night exactly how much my last years worth of abbey charges come to so far its totalling £1,000
Now to begin with i presumed that if my claim was smaller then there would be more chance of abbey choosing to play ball and paying up
however now thats its going to be totalling far more than i ever thought, im slightly more worried that it will go all the way to the money claim online stage
Oh well i'll get out my shield and my sword and fight it all the way :-)0 -

TREACLE1961 wrote:MANY THANKS FOR YOUR REPLY EDINBURGHLASS I WILL GO BACK TO THEM AND TRY AND GET STATEMENTS TO BACK UP THE LISTS OF CHARGES BUT I HAVE ALREADY STARTED MY MCOL WHICH THEY OBVIOUSLY WILL BE DEFENDING BUT I HAVE INCLUDED THE INTEREST CAN I ALTER THE CLAIM OR DO I HAVE TO STICK WITH IT ?
Right, as you have reached the MCOL stage the list and description of your charges will form your defence and this will be checked by the bank and they will remove any charges that are wrong. I can only suggest you wait and see what happens now.0 -

You've advised not to include interest when asking for your charges to be refunded, is there a particular reason, when do you apply the interest?
Reading Martins advise he recommends adding interest to use as a negotiating tactic and to push them to pay quicker to avoid the interest later.

I am getting a bit nervous as Abbey has entered a defence for my claim of £4750 through money claim online, so now it is transferred to court. Has anybody got any advice or help to offer, I don't really relish the thought of fighting it out face to face with the bank, or are the bank trying to push me to give in now. Help!!!0

Have a look at the Reclaim Help Thread where you'll find a guide to the Allocation Questionnaire which will be sent out to you.0

Many banks are filing defences and then paying up before the court date. DOn't worry, it's just their way of hanging onto your money as long as they can.0
