Hi, sorry for the repeated question but i cant seem to find the right address on the website to put on the form for mol.
I have just had the standard letter back from Abbey saying that they will be investigating my claim and it will take 4 weeks yadda yadda!
the 14 days i have given them are up on wednesday 28th feb, not sure which road to take next.
Do i give them the 7 days and send them the 7 day letter? or should i just start the claim with mol straight away?
thanks in advance, everyone one here has inspired me not to be frightened to take control! The prospect of taking them to court isnt that bad anymore!!
Just want to make sure i do this right!0 -
i have received the standard sorry to hear about your complaint letter we need 4 weeks to investigate blah blah blah

Hi everyone
I thought it should be known about a new trick Abbey have got up their sleeves!!
Abbey had until sunday to file their defence and today I recieved a notice from the post office to say they were unable to deliver a letter because it didn't have enough postage on it!!! When I got there it had no markings on the envelope and it had a stamp!! Banks don't use stamps they have their frank thingys!! So I had to accept it I didn't know what it was. Then low and behold it was Abbey saying they had filed their defence and that they would be prepared to settle for the full ammount they owe me. They were quite patronizing..
So if anyone wants to know I have claimed £685 and have now recieved £690!!! Well chuffed!0 -
new to me anyway!!0

i'm in the middle of claiming £2250 back from the abbey and have issued a claim at court. four weeks into the process i received a letter offereing a settlement of a measly £600.
i telephoned and sent a recorded letter straight away stating that i will not accept this and will continue with my court claim for the full amount
is this the correct way to pursue this?
thanx0 -

You need to send the letter before action giving them 7 days before starting the court action.0 -

my claim is also with the abbey £5587 and i think they're one of the most stubbon to deal with but stick to your guns and send you'r seven days court action letter.

bootlemike wrote:I'm due to put my papers into the court next Friday (2 march). Yesterday I got a letter off the bank (Abbey) offering me 10% of what they owe me. The letter states "as a sign of good faith" they will refund £350 to my account (the 10%) within the next 10 days and will consider the matter closed if they dont hear from me in 8 weeks.
Today I find that the money has already gone in my account without me accepting their "good faith", I phoned and asked them to take the money out of the account but they refused. They stated that I was free to continue my court action and, if I was awarded more, They would deduct the £350 any future settlement. They said I was free to spend the money at will.
I immediately began worrying this may be seen as an out-of-court settlement, what should I do?
I don't want to touch the money but unfortunately about £80 of it was used to cover a direct debit today. Im waiting for them to ring back and am considering asking them to put it in writing that they dont see this £350 as a settlement and that they are aware I am continuing my case. I am thinking of writing to them stating the same.
Any thoughts would be extremely helpful, I rang the FOS but they said they couldnt give advice.
continue with the court papers. :beer:0 -
Help, could do with a bit of advice, i sent off the first letter to claim back fees and interest from the Abbey (2 letters for 2 accounts) and recieved within 1 week a reply to both stating "very sorry your unhappy etc" they then went on to say we will look into it and write back with our findings within FOUR weeks to "let you know whats happening". Should i wait or hit them with the next letter straight away? Any advise would be handy. Thanks.0
