I have recieved money into my bank acocunt!! I originally asked for about £400 I got £185 straight into my account without even an explanation! Then I was really stupid and got charged (a lot) more so ended up taking them through the court system for £500 inc interest and charges for court. They have also deposited a further £185 directly into my bank account and seem to think the case is closed but they only have till sunday to enter a defence! Yay!
So in answer to your question yes I have had most of my money back and by the end of next week I should have had everything I asked for back with any luck!0 -

Hi I've just joined so please bear with me. I've just received a letter from Abbey saying they are looking into my complaint and they will get back to me within 4 weeks. My 14 day letter is due up on 28th Feb do I contact them amd make them stick to my timescale?0

The Abbey will jst send template letter after template letter,stating that it will take 4 weeks and they aim to resolve customer complaints etc etc,all it highlights their poor customer services,and the ability they have in an attempt to stall the process.
Stick to this site and you wont go wrong.I am at the Mol stage which is going in today.They offered me £35 for £700 of charges!!
Have not seen anybody lose yet,but i suppose the pessimist in all of us thinks that we could be the first one!
My mol is on its way,so lets see how they respond.0 -
i have recieved an a & q from the courts today and at the same time i have recieved an offer from abbey offering to settle the account , they offered me half of what im claiming for , obviously from listening to you guys im refusing it , but does any one have a phone number to contact this lauren bernard . thanks , oz0

I'm due to put my papers into the court next Friday (2 march). Yesterday I got a letter off the bank (Abbey) offering me 10% of what they owe me. The letter states "as a sign of good faith" they will refund £350 to my account (the 10%) within the next 10 days and will consider the matter closed if they dont hear from me in 8 weeks.
Today I find that the money has already gone in my account without me accepting their "good faith", I phoned and asked them to take the money out of the account but they refused. They stated that I was free to continue my court action and, if I was awarded more, They would deduct the £350 any future settlement. They said I was free to spend the money at will.
I immediately began worrying this may be seen as an out-of-court settlement, what should I do?
I don't want to touch the money but unfortunately about £80 of it was used to cover a direct debit today. Im waiting for them to ring back and am considering asking them to put it in writing that they dont see this £350 as a settlement and that they are aware I am continuing my case. I am thinking of writing to them stating the same.
Any thoughts would be extremely helpful, I rang the FOS but they said they couldnt give advice.0 -
I'm with Abbey and my charges only add up to about £300. I figured this much wasn't worth it for Abbey to o to court over. They sent me a letter telling me they're going to look into my complaint, but today is the last day of the two weeks they have to pay me back. Should I just send the letter threatening court, or should I call them first?0

right then, i've gone through the necessary stages and have issued court proceedings. I have now recieved an acknowledgment of service and been informed that Abbey intend to defend the case in full..is there anything i now need to do whilst the statutory 28 day notice expires.
In a seperate letter recieved on the same day Abbey have informed me they intend to put £175 into my account as a ``good will gesture` if i do not stop this will it affect my claim ?

Abbey are also defending my claim for £1800,My 28 days is up on the 9th march so i too am just sitting it out and waiting for there next move.I closed my account with them 2 years ago so i have not been offered any part settlement by them.Lets hope they settle before it goes to court.0
