  • I have received the exact same letter today! Just goes to show how little effort they put into looking at individual claims. Having seen the response from Edinburghlass (thanks) I shall pursue my Sherriff court action.

  • Could I ask, I wrote to Abbey to say respond in 7 days or I go to Small Claims, and assumed as I am in Scotland that I had to use Scottish Law, but is this the case and can I use the online service for English small claims courts as Abbey are registered in England? This system seems somewhat easier than raisng an action in Scotland!

    The Abbey is fianlly starting to buckle, and having entered a defence to my claim of £5684.59 (including interest), I received a letter this morning stating that they are willing to offer £2842.30 as a matter of goodwill and without any admission. Having read through the websites about claiming back bank charges this seems quite a low offer. Has anyone been in this situation and written back to the bank stating that they would accept a settlement but of a different amount. As I said I have trawled the websites and initially I was thinking of asking for a claim of 85% and accepting at around 75%. Is this me just being greedy or has anyone done this and succeeded.

    Your help, as always is very much appreciated.

    You can use MoneyClaim if you use an address in England, have a read of this website...

    If you refuse this offer you will more than likely get another so you could try saying what you will accept.

    50% is a very low offer, especially since you have already issued a court claim. If this was before a court claim, I would suggest making an offer for a lower amount if you wanted to accept this, but seeing as you are already in the court process. I would suggest you stay strong and follow this through. The chances of you getting the full amount of charges+interest+court fee are excellent. This only requires tou to stick with your case and not buckle under any pressure/nerves.

    Keep the interest the same in all your letters up until your court claim. Just before you file a court claim, re-do the interest and claim for the updated total.

    I have wrote to the abbey requesting they pay back my charges and they have sent me a letter about 3 days after recipt of mine telling me they will deal with my complaint with in 4 weeks - Is this acceptable proccedure or should they have made an offer with in 14 days of recipt of my letter?

    Any advice would be greatfully recived
