    I have sent a letter claiming £1725 to Abbey, and got a similar letter to £wise's this week, although they offered to "cancel charges as a guesture of goodwill" to the massive sum of £20!!!!!!!!!!!:mad:
    I then sent off a letter yesterday saying that unless they pay up, I will take them to court, and today I recieved a cheque for £20!
    I'm not sure what to do now, as the letters have clearly crossed in the post. Obviously I don't want to settle for £20, but should I send the cheque back, or just rip it up?

    Wait until tomorrow and then give them a call. Reading the stories of ALL banks they are busy with these claims and aren't always replying within the timescale set.

    just recieved a statement from abbey,it had 3 £30 charges on for some visa payments that went through 1 day before getting payed,all 3 payments took me £11 overdrawn i rang abbey and was told they are allowed to do this but did eventually refund them.
    i have a question for anyone who is more clued up about bank charges than me

    if it is unlawfull for banks to charge such high fees and this site helps you to recover them,why are the banks still charging them?

    Because for every person who reclaims the charges 10 people don't bother. Regardless of the bad publicity and loss of funds, they still come out ahead as all banks are just as bad - even if you move you're still stuck! I reclaimed from HSBC, but Abbey is just as bad!!
    I'm so sexy it's a wonder my underpants don't explode.

    I have just posted off my second letter asking for my money back, bit nervous now as to what they are going to do. As i still owe (ha!) Abbey £436they have sent the debt to a debt collection agency who i have phoned and told them that i am currently in dispute with abbey and have no intention of payin up until its all resolved. (does anybody know if this will affect my chances by the way?)
    After the 14 days are up, did you just file a claim on line with that MOL website?
    I have never taken ANYONE to court brfore so i'm a bit nervous as to how to go about it all, am just following the intructions and tips on here really!

    never be afraid to go to court! this is something i must emphasis to all, i recently took a garage to court and won a hefty sum of money, the Judges are human beings and in most cases love the 'individual v the company' cases. the judges are very intelligent people, and the banks know this, hence the banks lack of presence. the process is quite simple too, do not be afraid.

    The banks are still charging them, as they claim that they are lawful charges, and contained in the terms and conditions of your account.
    However, Case Law way back as far as 1896 highlights that if the charge is disproportionate to the actual cost involved, it is unlawful.

    so therefor the terms and conditions are unlawful as are the charges etc
    Statute is on your side too, in relation to the Unfair Contract Terms Consumer Contract Regulations 1999 and the Unfair Contract Terms Act 1977.

    What needs to happen, is for the Financial ombudsman and the Office of Fair Trading to make a ruling to stop them from applying over inflated charges, they have already done this with credit cards, well...taken a step towards it by reducing the amount of the charge to £12 which in many opinions is still to high, and i am sure that as a result of all the recent press etc and the rallying of Martin and his troops, along with other websites, this in my opinion is not far away, so expect to see changes afoot!
