thanks for clarifying that for me andypez,lets hope changes to bank charges happen soon.so long as people keep asking for money back then powers that be are under pressure to act.
basically then if you ask for your money back even if it does get to court so long as you are prepared properly with all the information needed the judge should rule in your favour and you get the money back?0 -

Not just that, but the process would then become simplified(with a process in place to claim which would be easier), there would be no delays by the Banks, Precedence would be set, and the floodgates would certainly open! bearing in mind that the banks make over 4.5 billion pounds per year from charges, only about £10 million has so far been claimed back(rough estimate), the banks may even be forced to pay it all back without people needing to apply!!(i know, i am dreaming!).
the best we can do is continue to encourage others to reclaim!

Just popped in to see how everyone's doing. I've finally got around to doing MCOL - I've been putting it off, but actually it was quite painless. I guess I've just got to sit back and wait now. It quite amused me when I used my Abbey debit card to pay the court fee.:rotfl:I have plenty of willpower - it's won't power I need.

I Used the template to request the details of all my charges from abbey national over the last 6 years also including a cheque for £10 as indicate
not really suprised at all to arrive home today to only find the details of charges for just 1 year, I did expect them to do something along these lines but I was just wondering what to do next.
In the letter I clearly states that I wanted for six year so are they not ignoring my request in every way.
If anybody has had the same problem or knows what I should do can you please please help me.

I hope some one out there can help me. I have sent a first letter to abbey with a £10 cheque and asking for 6 years statements and giving them 40 day's to reply.I sent it on the 3rd Feb recorded del they have recieved it.
Today the 15th Feb I recieved 1 year's statements I have checked my new bank account and they have not cashed the cheque should I write to them again or wait a few weeks. Is this the norm??? Thanks biljea0 -
Often the statements are sent out in batches so you need to give them a bit more time, unless of course the 40 days are up.0

when i asked for mine i got 12 months statements and a letter saying the rest are archived on microfiche and will come seperatly,about a week later i had a big envelope filled with a4 printouts for the last 4 years
so my advice is give them a bit more time

I have gone through the whole process with abbey and EVEN WENT TO COURT, needless to say abbey didnt turn up. The judge ordered it in my favour but said the new going rate for charges was £4.50, they then counted up the charges and deducted all the £4.50`S OFF THE TOTAL . Abbey have received judgement saying they must pay by today but still no money and no contact from abbey at all. :mad:
I`m not sure what to do next, I know I have to send in the balliffs but could someone please advise how I go about doing this.
Just to let everyone know, don`t be afraid of going to court, I was terrified but the judge was brilliant and really helpful. The really are enjoying these cases but not many of them actually get to court stage, just typical mine did.

Interesting that they took the small charges off your claim, which court was this as I wonder if this is a first?
As regards getting the money from Abbey, obviously you do have to give them the rest of the day to do this. Why don't you ring them and ask?0 -
Thats what I thought, it was sunderland county court, tyne and Wear.
The judge said this was the going rate(£4.50) but didnt say where this had come from, I got the feeling he knew more about this than he was letting on. He did mention that barclays was £5 and said it was not possible to expect no charge at all from the banks.
I will try and give Abbey a ring and see what they say, I have had no contact from abbey since september 2006, i have made numerous efforts to speak to somone but everytime I have rang they state no one available to deal with this kind of query???????
Another fob off by them.
