    I also had the same letter from Abbey, 8 days after I sent them a letter asking for a list of charges under the DPA (I wonder if this is just coincidence!). When I phoned them to ask what it was all about (as I had never gone over my overdraft limit) I was informed that under the t&c I had not deposited any money into the account in December - so they withdrew the overdraft without any warning and now I'm paying monthly charges etc. I would be grateful if someone could help me make my complaint in writing. I have already opened another account with A&L so I can close the Shabbey one as soon as I've paid the overdraft off.

    We have just received notice of issue from the court,and now Abbey have 14 days to respond.Feeling a bit scared as the issuing court is Northampton and we live in Durham.How will we find out if Bank defend the claim ? and what will happen next ? and why are the banks allowing these claims to be filed in court if they have no intention of disclosing there true costs in a court ?
    Any advice would be appreciated.
  • Amount trying to reclaim £1,060. Today just received a goodwill letter offering £320 now although i'm not going to accept this amount, i was hoping if their is any one who has received a simillar letter and what their next cause of action was going too be.

    Hi all,

    I am just on my 2nd letter, posted today, to Abbey National reclaiming my £4443.19, i have advised many people to do this and have even applied and assisted others with their claims.
    I am a Mature student and as most will know skint most of the time, so the opportunity to reclaim what is rightfully mine is an opportunity not to be missed!
    the beauty is, that Common law and statute, at this moment in time is on the consumers side(you and me) as a law student i took great pleasure in looking this up!;) even to the point of consolidating what i had learned from a variety of websites, forums, media, case law and journals, and submitting it as an assignment for one of my modules at university. (i'll let you Know of the mark when it returns lol)
    My point is this, do not be bullied by the banks, they have no leg to stand on, OFT has regulated and none or very few want to go to court as they don't want to expose their figures.
    take the idea of Reclaiming as a hobby, something to do while the kettle is boiling, it is a simple process which has a maximum gain great satisfaction, do not see it as a chore, or impossible! help is available everywhere, enjoy the process and relish in your own success and acheivement at the end of the day. this really is a no brainer!!:T
    I have Started with Abbey, my next letter is going out to Barclaycard, and also Capital one, wish me luck, i'll keep you posted.:cool:

    I too had a "goodwill" refund of 100.00, am claiming for 2,528.00 so the refund was not even close!! Their Complaints Dept said they considered the issue closed, so naturally I have made a claim through Money Clain OnLine, as looking at previous threads, this seems to be the only way the bank will pay up. Another 12 days left for them to defend the claim so fingers crossed.

    To anyone else, don't be afraid of issuing a claim, MCOL is very straightforward. All claims seem to go through Northampton so don't worry if you are not local.

  • an avid reader of martins e-mails took the plunge to claim bank charges and sent 1st letter.in this mornings post received 15 months worth of statements, which did include the overcharges that caused me to start this ,though i am sure over the six years i have incured a few others.still it is only £230 but caused me a lot of greif at the time.so on to stage two.

    You will be advised by the Court (and can check online if you went thru Moneyclaim but this can be slightly out of date). If they notify a defence, the 14 days is lengthened to 28 days for their response, then it will be transferred to your local court. They may try to write to you meanwhile but unless they offer full settlement (which does not seem to be Abbey's habit!) it is not a good idea to enter into correspondence.

    Hello everyone
    I'm in a bit of trouble too.. I've been claiming charges from abbey and have so far got £185 off the letters so I went to mcol for the rest and I recieved a letter from them saying abbey would defend well I checked my balance this morning and abbey have refunded a further £185 leaving £315 still outstanding. I am aware that I am suppossed to let the court know if they do this but I can't find any of the links to this information. Does anone know how to help me?! Please!!!!
