can anyone help me please, i wrote to abbey in december about unfair charges amounting to £3795, they didnt want to know, so i went through the money claim website, taking them to court, they have written back saying that they are going to defend the claim, what i need to know is , what do i do now and will this mean i might lose the case , also they are saying i didnt give them any info as to how i got to this amount, but back in december when i first wrote to them, i sent a copy of every statement to them0

Did you put it in your claim though?
Many of the banks are defending the claims but settling beforehand or failing to attend court and judgement is issued in default.
HOWEVER, from your post I am wondering whether they are saying your statement of claim is deficient and if it is, you may have given them a stick to beat you with. The other alternative is whether they are saying that you did not negotiate with them sufficiently before issuing proceedings but that is not really a defence to the claim, more a mitigation on their part which could lead the court to make an order in respect of costs so that you do not get your filing fee back.
If your statement of claim is accurate and has all the detail in then I would suggest they are using the tactic of lodging a defence to try to get you to back off but will then take it no further if you don't.
If none of this applies, it might help to type up precisely what their defence says so other here can help. It may be though that pretty soon someone else who has sued abbey will come along and reassure you that this is standard wording from them or otherwise.0 -

Dont worry, im at exactly the same stage as you, the letter they sent is very standard. Just send them another schedule of charges and tell them that they should already have this but as a gesture of goodwill you are sending again!
Once they file their defense the next step is for us to fill out the AQ that the court sends.0 -
I'll pop this into the Abbey thread but another user asked a similar question this morning and what they require to know is a list of each charge you are claiming, with a date and a description rather than copies of statements that you say you have sent.0

I've had an Abbey account for the last nine years, I reckon they owe us about 8K + (easily)
I have every bank statement since the account was opened, we pay in on average 4k a month, but had a problem with debit card charges - you go overdrawn - they charge you - they also charge you for a debit card debit while you are overdrawn (we have electron cards)
I am self-employed, my husband gets paid every 4 weeks, so no set time of month - 1st, 15th, 30th etc etc I used the on-line banking facillity and used to call clearing if a payment went out the same day cash was paid in.
You are clever people - I know it's long-winded but I'm sure you understand.
A £2.52 debit could cost us £62 in charges. On average we were paying £800 a month in bank charges. In the end we went to our local branch to see the manager. They gave us a 'managed overdraft' of £750 reducing at £63 every 4 weeks (when my husband got paid)
We went to France 2 weeks ago, while we were away we went overdrawn on our overdraft.......they have withdrawn the facility, we are now £620 overdrawn, my husband gets paid Friday 16th.
While I could pay in enough cash to pay the overdraft off before he gets paid, I feel resentful after nine years and an awful lot of interest and cash they have earned off us, to do so.
I no longer pay my earnings into the account, and we don't have any DD or SO on the account. Some companies offer an incentive to pay by DD - it's never enough to cover bank charges.....
I thinks it's probably too late for my husband to have his salary moved elsewhere, so they can have their £600 in time and his salary - then they are 'having it !!!!'
Anyone any advice when dealing with the Abbey ? I am quite willing and able to do a speadsheet listing charges and dates etc etc, but forwarned is forarmed (or something)

Thanks - just finding my way round the board.
TBH : We've nothing to lose, they've had the money and if (and when - they seem crafty compared to other banks) we get a result, then Capital One ad Barclaycard are 'having it' too!!

This has probally been answered before but cant find it without going through the whole thread
I am helping my daughter with her claim with abbey, on the statements that are from microfiche details what am i looking for, I have found some CHG but are there any others, there are a lot for counter fee of £3 , what is that about?

If you don't know what the abbreviations mean, phone your bank and ask them to be sure you are correct in what you are claiming.0
