  • Hi this is the first time I have been on this forum. I need at bit of help. I am due to go to court on 27th November and do not have a clue on how to prepare and infact what to prepare, can anyone help!!!!!! please please
    you need to get your court bundle together, this includes all letters to and from the bank..all court letters received ...all correspondence from the solicitors etc, your schedule of charges a copy of UTCCR 1999 and bank statements. any other evidence to support your claim also.

    Try this link to the CAG website, you will probably have to register with the site to log on, but this site gives you a full list of everything you will need to take to court with you.

    Nice to have a little extra spends!

    But because of the suspension on claims while the test case is heard, I didn't reply to them once I got home,

    so if the court outcome says NAUGHTY GREEDY BANKS! PAY IT ALL BACK! (lol) would I be able to chase up the remaining money that I wasn't refunded, or have I lost the chance now by not continueing regardless of the test case?

    Many thanks to all for help and advice, without your posts here, I would not have had that £300 back, so big up to Martin and ALL moneysavers! :)

    Hi All,
    Long time no threads hope you're all OK. got a letter from St Helens County Court which reads, it's a bit long winded but bear with me:-

    "The hearing of the defendant's application for To Stay (see copy attached) will take place at 11:10 on the 8th November 2007, at St Helens County Court.

    Cases are listed in acordance with local hearing arrangements determined by the judiciary and implimented by court staff. Every effort ismade to ensure that hearings start either at the time specified or as soon as possible thereafter. However, listing practices or other factors may mean that delay is unavoidable. Furthermore, in some instances a case may be released to another judge, possibly at a different court. Please contact he court for further information on the listing arrangements that may apply to your hearing".

    Couple of questions
    1 Do we need to take our court bundle with us with copiesfor Shabey, judge & ourselves?

    2 Should we expect the Stay to be granted?

    3 Is there any point in turning up?

    Hi everyone

    I am new to the site so forgive me if anyone has had similar experiences I would love to have some help.
    1) I started my claim in April 07, was waiting for Abbey to send in the remaining statements 04/05 which I have only ever received only statement of charges.
    <o:p> </o:p>
    2) I went to the ombudsman and asked for them to help settle my claim andAbbey paid £435 into my account, I told them I didn’t want it. So I proceeded with my claim and was told that they were sending out a letter with an offer.
    This I never received and all bank claimed were then halted and no one would give me an update on my case, claiming all computers were also on hold.

    Since then, they have taken £150.00 from my account for being overdrawn by £2.98 for 1 day and this is now really made me fight.

    I sent the money claim court notice and I have a Notice of Issue being sent to Abbey and the case will be heard in <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" /><st1:City w:st="on"><st1:place w:st="on">Northampton</st1:place></st1:City>.

    So what else do I need to do any advise you can offer will be greatly appreciated.

  • :money:Thanks to Martin and this site i applied to Abbey to repay my charges after in one week alone they took out more charges than i depoist in a month and thought enough was enough and put in a claim for going on £3,000.00 They repaid about £250.00. and then of course the crap hit the fan with the court thing a OFT and now will not repay anymore until the caes is over. Perhaps i am a bit simple in my veiw. if they have paid part then they have aleady ready made it clear they are liable and should repay the lot before the hearing.
    Perhaps i am wrong and there is some legal point that allows them to do this. :confused:

    I think thats when i need them for (the dates above are when charges were made)

    Any ideas?? please please please
    I have looked on the consumer action group but the links dont work or i cant find what i need

  • I had a bank account some 4-5 years ago with abbey national and had refused to pay any charges on the outstanding balance because I felt the charges were totally unjust. I wrote to abbey recently about the issue and they told me they had sold the debt on...


    Does anyone out there have any advice on how I proceed or will I just have to pay it now its with a collection agency, its £120 pounds but its the principal of the matter.
