    Yes, but you can still send the preliminary and LBA letters to Abbey and then decide whether to file a claim at court or wait until judgment of the OFT test case

    Sorry if this has been posted elswhere. like many of you my claim against Abbey for charges has been tied up in the system by the stay. My question is what was the cut off period. I am hearing that it was the 27th July.
    I made my claim to the court on the 13th July and got confirmation that it was logged on the 26th July. Do i have grounds to appeal the desision of the court to uphold the stay.

    No.

    MCOL automatically stayed all bank charge claims where the banks defence was filed after August 13th 2007
    The OFT judgment is expected this Thursday

    Hi

    Been reading through some of the posts on here and everything else about reclaiming bank charges. I have just posted my letter today to the data protection address for Abbey using Martin's template letter. Not sure what will happen now but here goes. Anyone know if they send you details of charges or if I will have to go through 6 years of statements with a highlighter?

  • Hi there - I think I would have a case against Abbey National but I did close my current account with them last year and moved to HSBC. Can I still claim? I kept a savings account with them in case I had to still be a customer to claim. WOuld appreciate some help on this please. Thank you!:confused:

    You will need to go thro your 6 years worth of statements, be careful though as the charges will not be printed on the front as they are on normal statements. You may get some them in table form. When you get all the info use martins letter templates and interest calculator on this site.

    I have asked this before i think but just got off the phone to abbey as i noticed i was 2.36 overdrawn and they have very nicely told me i am getting charged £35 for the privilege, i am just on my way to town to put £800 in the bank, i wasn't going to go for my charges back from them but have now decided to as that is ridiculous.

    The thing i need to know is: i have an od that i am currently paying off as they took it away from me last year when i had a maternity break from my mortgage and there wasnt enough money going in the bank it was for £1500 and we now have over £3000 a month going in the bank, i still owe £850 that i pay £85 a month back on, is there a chance they may take that away from me totally or can i close the account and set up a standing order with another bank to pay it?

    Sorry for the rant but very very annoyed now

    I got statements had a site say they could do it for me am with abbey rang abbey they said it was all in hand ........guess what the company doing the reclaiming have gone and abbey.........well have you tried ringing them lately I gave up after waiting 15 minutes listening to a phone ring!!!
