I have sent off for my statements with the Abbey, with a view to claiming bank charges. I have an overdraft of £2000, however bank charges have now took my account to £2508. I have just changed jobs and will be paid the end of this month. I have had no wages go into the account for nearly 2 months. I told the bank I could start paying my salary into te account at the end of this month. Now I have received a letter asking for the cards and cheque book, and to make arrangements to pay, otherwise they will charge me another fee to pass onto agency. If they do this, will I lose the bank account and the right to claim. I am obviously in disoute with the charges, although I haven't paid them, although there are more going back over the last 6 years.

Been reading through some of the posts on here and everything else about reclaiming bank charges. I have just posted my letter today to the data protection address for Abbey using Martin's template letter. Not sure what will happen now but here goes. Anyone know if they send you details of charges or if I will have to go through 6 years of statements with a highlighter?

I requested details of the last 6 years bank charges from Abbey about 3 weeks ago and received details of charges only in table form from 2001-2007 and 2007-present in the form of statements. Received information yesterday and will be sending my second letter on Monday requesting my money back... fingers crossed:rolleyes: .0 -
I settled before court proceedings approx 18 months ago accepting a 50% settlement.
The claim was for £1200 and I accepted £600. The reason for this is that I was strapped for cash at the time and I didn't really want to wait until the court test case.
However do I have a valid case for reclaiming the difference now in view of recent developments or was my acceptance full and final.0 -

Thanks to martin and members, there is an abundance of info on reclaiming but there is so much I am confused.
I am reclaiming from Abbey and this is my progress.
on letters sent and they were all sent by recorded delivery and I have copies of letters.
1--17/11/07 asked for list of charges which I received.(martins template)
2--16/12/07asked for them to repay the amount sent to me(ditto)
3--1/1/08 sent second request for repayment of no 2 and gave 14 days(ditto)
had a letter from Abbey saying they are waiting for case.
I then wrote to FOS and filled in their form with details and they sent me the copy back 5/3/08. They said they had informed Abbey about my complaint and asked them to record my complaint.
The only thing I think I have not done is write to any court. so I would welcome any advice please, either in forum or PM>0 -

Just helping my Dad start his claim and yes Tigger that is where we sent the intital DPA request letter to. The letter was sent on the 20/4/2008 and he got the charge tables today detailing charges until the end of December 2006 and duplicate statements to follow from that period on in the next 5-7 working days. Just something I need to confirm before going ahead - ignoring any charges and refunds before May 2002, do we ignore any charges where a refund for the same charge type is showing in the table - e.g. a £30 unpaid Direct Debit charge in one month which also shows a £30 unpaid direct debit charge refund? I realise where, for instance, £60 has been charged but only £30 has been refunded that £30 of charges still obviously remain to be reclaimed.0

The table of charges from 2000 arrived yesterday and the statements from 2007 to now are to follow. Just got to work out what to do next now.
Am not sure which bits to claim for but am going to check out Martin's advice on the site a bit more today which should help.

When calculating the exact date of the charges using the table they sent, does anyone know what date to use? In my dad's case he seems to have the charges taken on the 22nd of the month if the month had 31 days and on the 21st in all other cases - is that the date to put in then or do you put in the date the charge was actually incurred which would be sometime in the previous month and would mean ordering duplicate statements to find this out?0

Hi I used the date on the statement for calculating the charges, as the charges incurred during the previous month are debited the following month, not immediately

Just to clarify then, if a charge was incurred due to a Direct Debit failing, say, on the 13th of March and the charge was deducted from the account on the 21st of April, you used the date of the 13th of March - is that correct? If so, Dad wouldn't be able to claim against a few charges as they would have occured beyond the 6 year Statute of Limitations period0
