    Thats right add up all the columns & take off the refunds, put all the charges onto the bank charges calculator (link below)

    When your statements arrive, you will have to trawl through every page, and look for anything with a CHG beside it is a charge, put these onto the calculator also, this will work out the interest that is due back also.

    do i have to do each bank charge individually for the interest as some are in 2002 and some in 2007..??

    Hi again,
    Just put all the charges into the calculator, doesn't matter about the date as long as none of the charges are over 6 years old as these are statute barred & can't be included. Print the calcs off & if you copy them & paste them into a word document you can keep a copy in your own files

    Not necessarily. The FSA "stopped" the clock on the 27th April 2007 which means, in theory anyway, that in court cases in England, Wales and Northern Ireland, and in cases that are decided by the Ombudsman, you could potentially reclaim for all charges incurred from that date onwards. However, on another thread I started on this, no-one has conclusively said this is the case but reading Martin's article about the court case result, it does certainly sound as if this is the case.


    Was there ever a definitive answer on this please ?

    i have done everything now and i am about to send the second letter for them to repay all the default charges.

    just one thing am i right in thinking that the address to send this letter is

    You've got the right address. Good Luck, you'll probably get a letter back stating the "Test Case", this is a standard letter, to tell you that they are going back to court to appeal against the judgement. Stick to your timescale & carry on with your reclaim

  • Abbey will ask that you agree to never claim back charges again - which is a cheek to say we overcharged you, got a way with it until you asked for a refund, but be warned we will never refund overdraft fees to you again. So i agreed to the verbal contract to get a 70 quid back over a about 10yr banking period. lol

    it says on the site to just wait after i have sent the letter asking for my money back and they have replied


    What happens next
    Most people should get a letter back from the bank acknowledging the complaint, yet saying that the financial regulator, the FSA, has given it permission to suspend all bank charges complaints. The same is true if you try and go to the Financial Ombudsman. Ardent and experienced reclaimers could try and continue with your complaint in the county court, but in most (although not all) that will be put on hold too.

    After first starting my claim before the current test case rubbish thats dragged on and on making the banks even more millions i have only ever recieved 2 letters from abbey themselves!

    the first was my statements the second i have just recieved that funnily enough just goes on and on about justice andrew smith and how there charges are " not unenforceable penalties; but are reasonable for fairness under the UTCCR's" bull5!!!!..

    would it be worth my while writing to them just to ask for a settlement as my case waits gathering dust in some court somewhere as i keep reading on here about people getting there money back even now after they have all been put on hold !

    i think its downright rude and unfair that the banks can just ignore everything and every letter you have sent them then when they see fit they can send this bull5hit letter to everyone saying that they have done no wrong, its a joke .

    has anyone done this already and had success or is it not worth the price of a stamp in the situation we are all in at the minute ?

    I have claimed nearly £2500 + interest and am stuck stayed in court at the minute, also is this amount gaining interest at 8% all this time as its been over a year now
    ive just had enough of it all now its a joke the whole system is a joke .

    can anyone advise on this matter
