    The only decision, so far, gives the OFT the right to investigate on grounds of fairness (against that, the banks have appealed).
    A final decision whether or not these charges are illegal is a very, very long way off.

    Morning all have just been reading a very interesting thread on Legal beagles, lady has just been offered 70% of her claim.:j
    There were also comments that a pattern seems to be emerging that Abbey. lloyds and Halifax are starting to make offers??????
    Has anyone out there had any news???
    The mood on the thread seem to suggest that things may be turning in our favour???:confused:
    Lets hope so, I am so frustrated that Shabby can still charge extortionate fees:mad:
    Anyway any news anyone???
    Am off to search some other threads for news.

    Lets hope they are starting to move, but don't you think, they will only make offers that are prefferential to the banks, rather than than the "customer"? Got to admit though would rather get this over with, and get something back off the robbing gits lol

    Long time no see!
    If I have understood it, I think they are talking about hardship cases, under the terms of the waiver if the OFT wins in court the banks must then settle the whole claim even if a partial settlement has been made.(sounds like a win win situation to me). The thread on Legal beagles makes very interesting reading, sorry I don't know how to set up a link.
    Off to do some more research.

    I do hope someone can be of help please as i am literally on the verge of tears again.

    I specifically left money in my Abbey account to see us through until this Tuesday.
    Money is extremely tight at the moment as i have the hubby off sick and having to claim a benefit, three children to tend to, one of them more delicate, bills to pay and me on the verge of a breakdown.What didn't help was when i went to check my account online yesterday and see that i was greatly overdrawn and that the bank had charged me several £35's in their charges. Leaving us without a penny. No money to pay for the electric, food and bills. I'm already behind on my bills which is not good. I had the money to pay via the direct debits set up, but the banks just kept charging whenever they possibly could leaving me in a vicious never ending circle and several nasty company letters. I don't know how i'm going to cope at the moment, to make matters worse is that when my next payment comes, the bank is going to guzzle it up again. If it does then it's going to simply push me over that edge . I just don't know what to do. The bank knew in advance that my hubby is in receipt of benefit, and that we are in no position to challenge them. I have had my account with them for a few months and it's killing me that they are doing this and are allowed to get away with it.

    we are in no position to challenge them.

    You are ALWAYS in a position to challenge them.

    First step RING the bank - tell them exactly how dire your situation is - don't ring daft call centers - try and go to branch or call the branch if you can and talk to them face to face.

    You don't need to use any jargon about bank charges and test cases and stuff, just tell them you are suffering severe financial hardship and could they see there way to refund some of these charges on this occassion.


    They might not agree, or might just refund some but that helps.

    Second....get a post office or another account open somewhere else...don't have an overdraft on it....just open it and get the benefits and any other income switched over to go in there.

    Then you are back in control.

    If the bank do refuse outright I'll help you with a letter detailing your rights, their responsibilitys under the banking code and a bit about the legalitys of charges etc.


    Then we can go through everything...all your income expenditure, debts from ground up and try and get you feeling like you are in control of things. I know how bloomin easy things spiral out of control.

    But try calling the bank first - DON'T let them upset you, if they say no you gave it a good shot and we can do it more formally.

    Please Please PM me when you post back on here, becaue I don't come on MSE much and have been asked to pop over and help.

    can anyone please help..... i started the reclaimin process, and i have been sent all my statements from the past 6 yrs... now.. i know i have to write back to them askin for the monies owed, but martins template letters state that i have to give detailed descriptions of wots owin... does this mean i have to send my statements back into them.. highlighting the charges..or i have to write down and date every charge??? i know this may sound trivial to people who have done this before but im just so confused?? please can anyone just steer me right?? thank you....:confused::confused: :beer:

    Once done print off several copies because you cannot save it or , highlight the text in the window, then copy (Ctrl + C) it and paste into Word.
