I have asked for my £350 back from the last few years and read that they are "not to proceed with any other case they are hearing until the test case is resolved"...I thought this had been resolved?
Are Abbey repaying the charges or are they holding back?
any information on Abbey's stance at the moment would be appreciated..

In Oct 07 I wrote to Abbey claiming over £300 for overdraft charges, without interest. They have just sent me an offer for £89 which seems quite low to me. Should I accept? What other options have I got?0

Hi. I sent off the first letter asking for my statements which I got. Then I sent the second letter to my branch asking for the charges to be repaid. I waiting over the 14 days and I didn't hear anything. Next I wrote to the data protection address again (the one I sent the first letter to) as at least they had replied to me telling them that although the case going through the courts etc I would still like a reply to my letter regarding having my charges repaid to me. I have heard nothing.
I've looked on the 'success stories' thread here and none of them seem to be anythign to do with Abbey and I'm wondering if anyone has had any luck with Abbey at all and can give me any advice on what to do next please.

EDIT - I have had a reply now which is the standard one saying my claim has been registered but they can't do anything at the moment as everything is on hold. At least I know that my complaint has been registered and now it's just a case of waiting as Martin says.0 -
Is this a credit card or bank charges case? The choice as to whether accept an offer is your and yours alone and must be dicated by your own personal circumstances. I would re check all of the steps Martin has indicated and look at what he has stated. Then and only then, make a decision. At the moment it is £89 that you did not think you would have which is a result regardless.0

Thanks for your comments. This was a claim for overdraft charges.
I followed Martin's steps to the letter, setting up a parachute bank account and using his template letter.
I guess I will accept the offer as I just don't have the will to battle on endlessly for what is a relatively small amount of money. However, when compared to the success stories on the forum where people are reporting over 90% claim settlements and in some cases over 100%, I wonder why my settlement in percentage terms is so small - less than 30%! Is this the banks hedging their bets prior their appeal to the OFT ruling going through or was I just unlucky?0 -

Question to ask yourself is whether a bird in the hand is worth two in the bush.0 -
I was unaware of many 100% offers going out since about July 07 so the question is whether to wait or whether to take it. The amount is irrelevant. The question is whether you need the cash NOW or whether you can wait maybe until next or maybe later. Whatever you decide is the right thing to do.0

i received a letter back today saying that the bank acknowledge receipt of my complaint but cant do anything until after the legal proceedings with the OFT have been resolved
i take it that i just sit and wait now until after the case...??

Hi,
I'm after some advice - before the test case i asked the bank (abbey) for my charges back - which came to around £3,500.
The bank offered me about £400 back and just paid it into my account as returned charges the same day i recieved the letter. They said in the letter that this was to settle the case and no further action could be taken. i was not asked if i agreed with this. literally days later the test case began.
Now that the charges have been deemed illegal do i have any grounds to go back to the bank for my charges or have i given up my right by being given the money?
